Preliminary Hearing 10/1/11. Day Five. Discussion Thread

I think it's legal/you can get on prescription in the US, but it's illegal in some European countries as far as I know.

I know, I read that. I guess I am still blown away that he feels the need to ask for something so simple.

Seriously! And this -

He said his patient were complaining of injection pain. And wanted to know if I could make a topical analgesic.

BIG RED FLAGS FLYING - This guy ordering boxes and boxes of Propofol seems to 1) have never used it before 2) Not learned how to administer it properly and 3) Have no resources to refer to - Why is a trained, practicing doctor asking tons and tons of questions...and to a pharmacy?!

Was ephedrine mentioned in the toxicology report?

I believe it was.

It's "ephedra" that is illegal in the U.S. But not ephedrine? They are related medications, though. Usually used for weight loss/energy. Ephedra was used as a weight-loss supplement, but there were cardiac deaths related to it, and it was taken off the market.

Right. Notice that Murray also said that he was the ONLY doctor Michael had been seeing. Guess Klein doesn't exist?

Hi Autumn !
are you sure ?? the way I understood it from Sprockets notes is that he was asked if he was the only doctor , did I get it wrong ?

The first witness of the day is Stephen Marx--a former computer forensics examiner in the DEA lab in Virginia. Marx examined Dr. Murray's iPhone.

Marx says Murray received an e-mail on June 25, 2009 at 5:54 am (L.A. time) from what appears to be an insurance broker in London.

Marx testifies the e-mail's sender was inquiring about Jackson's health.

The e-mail is confirming Murray was the only doctor Jackson consulted during a 3-year period & asks about press reports re: Jackson’s health

Murray responds: 'as far as the statements of his health published by the press...they’re all felicitous, to the best of my knowledge.'

Thanks !

the L.A times blog says murray was the one taking the caffine asprine etc. yet others say it was mj

So the caffiene, aspirin, and ephedrine found in Michael's home has now been revealed that it could have been Murray's. Wonder if the media will highlight that then.

apparently Murray told the pharmacy the energy formulations was for himself but I believe the prosecutors are arguing that it was actually given to MJ to offset the effects of propofol.

Marxs confirms email was created on sent from the iPhone.

And dismisses press news about MJ's health.

Murray says in the email he was denied the authorization to release Medical records (for insurance)

Hmmmmmmmm

It may be bullshit :fear:, but I was thinking... And the such a medical examination that AEG said that Michael did? I do not remember the name of the doctor... Maybe this doctor has something to say or maybe the medical examination was never done.

Well, it was for the insurance for the tour so maybe only Murray was mentionned in the contract -even if Michael nor AEG never signed his contract- and Klein was not in it.

yeah cause all that stuff in those pills were found in mj

The next witness is Tim Lopez. He is a pharmacist and runs his own business, Applied Pharmacy Services, in Las Vegas.

Lopez says in Nov. '08, Murray called him to get a cream to treat vitiligo. However, the cream wasn't available to Lopez.

Lopez lost contact with Murray & heard from him again in March '09. In April '09, Lopez says Murray ordered packages of the vitiligo cream.

In the same month Murray contacted Lopez to let him know he was happy with the cream. Murray then inquired about Propofol & saline bags.

April 6: Murray placed an order for 1 carton of 100 milliliter vials and 1 carton of 20 milliliter vials of Propofol & 9 saline bags.

He also duplicated his order of Benoquin, the cream used to treat vitiligo and asked that his order be shipped to his office in Vegas.

Murray then changed his mind on the shipping location and asked that the shipment be sent to the address of Nicole Alvarez.

Lopez testifies between the months of April & June, Murray called his pharmacy at least 7 times to place specific orders on different drugs.

Some ordered drugs were lorazepam, midazolam, propofol & flumazenil. Murray requested that each order be sent to the Santa Monica address.

Lopez is shown a series of sales invoices/shipping documents pertaining to Murray's orders.

Some of the receipts misspell the recipient's name as 'Nicole Alvarie' rather than Alvarez. The last is dated June 15, 2009.

Wow, Harvey just said on TMZ Live that the amount of Propofol found is really strong evidence for the prosecution and it is getting really hard for Murray to get out of this all now...Wow...So far Harvey has been saying it's not a sure case at all and sounded more like Murray will easily walk. But now even he is saying things are getting really bad for Murray. Yeah, I know Harvey isn't the "know it all"....but he is a lawyer afer all and it's very interesting to hear even he thinks the prosecution now really has some serious evidence against Murray...

TMZ Live is on now...they will answer questions about the Murray case among others....www.tmz.com

You're right -
I doubt the insurance has agreed not have an medical examination report before insure the tour and the doctor must have been named by themselves

harvery is an idiot this evidence is hardly new and its not like murray never admitted buying the stuff. so hes trying to hype it up by saying this is really bad when b4 murray could have walked.its always been bad.

As a pure herb or tea, má huáng, containing ephedrine, is still sold legally in the USA. The law restricts/prohibits its being sold as a dietary supplement(pill) or as an ingredient/additive to other products, like diet pills.

from wikipedia

so pharmacy used the over the counter natural herb format, perhaps?

And that evidence last week was......I think personally this is all being done to try and get Murray to accept a plea deal. Make him realise this evidence is overwhelmingly against him and there is no way out. Sadly that way he'd probably just get a suspended sentence.

wonder if murray could be done for some kind of insurance fraud. when u look at that email hes lied in it several times

I believe this to be the truth.

Pretty much. Ephedrine is obtained from the herb Ephedra. Ephedra is illegal and Ephedrine is not, but products containing either that are marketed as dietary supplements (such as ECA stacks...) are illegal.

Basically, Murray was having illegal stackers made for either himself or Michael. These are dan-ger-ous. I have first hand experience. They cause rapid weight loss (the point, usually...) and a scary scary type of artificial energy - shaking, clenching muscles, rapid heart beat and lots of anxiety.

I never understood why in the world would Michael get vitiligo cream from Murray when he was seeing Klein all the time?

That's what a prosecutor on CNN said also, that she thinks that the prosecutor in this case is going all out to show Murray what they got to get a plea deal out of him. On the other hand, if they have all this, I doubt the prosecution will even consider a plea deal. I hope not. I hope they will go all out during trial also.

I find the fact that there was correspondence between Murray, the insurance company and AEG the day Michael died very very unsettling. Am i right so in thinking that insurance had not yet been secured in case of cancellation of the concerts and that Aeg were aware of this ? And that two days previously Randy Phillips of AEG was aware that Michael was unable to rehearse and sent home by Ortega...Was MJ suffering the side effects of propofol that day? How the hell was Murray planning on treating Michael in London or did he know he wouldn't make it that far? My head is spinning. This is all just too much. It's unreal, unreal. OMG the amount of propofol ordered by Murray. I am in shock.
Poor Michael. I am hurting for him right now. What a gigantic mess he was in.

when the hair samples are published all those vilas of propofol would be worthless. so what if he bought them, he did not administer them . That's why he said only 50 mg daily. Murray knew what he bought and what he gave and he created a script around it, as usual you are putting the focus on propofol when the focus should be on the 20 vial of lorazepam and 20 vial of midazolam

If unused where the hell is all that propofol now... if the propofol was sent to LA to the girlfriends house what was in the boxes that were removed by his staff in houston? Was that just a decoy?

100 x 90mls of propofol in three months ordered by Murray, how the hell did the pharmacy not think that was a bit odd. And how the hell does he still have his medical licence after all this!

According to UStream they said on CNN all the Propofol ordered was 15 liters. Sounds even worse that way.

If unused where the hell is all that propofol now... if the propofol was sent to LA to the girlfriends house what was in the boxes that were removed by his staff in houston? Was that just a decoy?

Who knows what else he had to hide.
