Big Update in Raymone Case! MJ Responds

Michael Jackson only became aware of this case on June 7th whereby he quickly acted to appoint the legal team he now has in charge of it. He was only informed of it through Frank Dileo who learned of it via the media, and never through a formal summons.

Michael needs to hire TSCM or someone to keep track of all the lawsuits and internet rumors and accusations.


Also I woiuld like to know what relations Dileo has with Michael. I wonder has Frank talked to him about the AGE lawsuit yet?

Mr. Jackson shall render a payment made payable to you [Plaintiffs] in the amount of four hundred and eighty-eight thousand, eight hundred and twenty dollars and five cents ($488,820.05) as full and final satisfaction of any and all monies, known or unknown, to be owed to you by the Jackson Parties with respect to any and all agreements whether verbal or written that you may have entered into with the Jackson Parties from the beginning of time until December 27, 2007 (the "Payment").

Except as otherwise set forth herein, in consideration of the Payment and other consideration provided herein, you [Plaintiffs] on behalf of yourself, your respective predecessors in interests, successors and assigns, representatives, partners, parents, subsidiaries, affiliates, members, officers, directors, agents, attorneys, employees, insurers, donees and licensees and each of them as applicable, do hereby absolutely, fully and forever release, relieve, waive, relinquish and discharge the Jackson Parties and each of their respective predecessors in interest, successors and assigns, representatives, partners, parents, subsidiaries, affiliates, members, officers, directors, agents, attorneys, employees, insurers, donees and licensees and each of them as applicable of and from any and all manner of action or actions, suits debts, liabilities, demands, claims, obligations, costs, expenses, sums of money, controversies, damages, accounts, reckonings, and liens of every kind or nature whatsoever, whether known or unknown, suspected or unsuspected which you shall or may have, own or hold, or which they at any time heretofore had owned or held against the Jackson Parties by reason of, arising out of or in connection with any matter whatsoever.

5. Waiver of Rights Under California Civil Code Section 1542. Mm. I wonder if somebody or somebodies were in cahoots with Ms Bain. Some peeps will stop at nothing to bring MJ the conglomerate down. There is a lot of $ at stake in the industry. Some peeps would rather it line their pockets than MJ's.

Why would Ms Bain bring this thing to court? She surely knew about that document. Maybe somebody or somebodies are willing to seize any opportunity to attempt to bring the man down, and they saw this as a chance to do so- by enlisting Ms Bain to bring up ridiculous charges, possibly for a fee; that way she gets $ no matter what the outcome of these proceedings.

Hey, who knows. With all the strange stuff that has happened to MJ (like the trial that should never have been,) maybe this is just more of the same. Or maybe Ms Bain is just plain greedy like so many others. By the way, the 44 mil. is massive, but then peeps usually ask for way more than what is reasonable in these cases, no?

Maybe same thing is going on with the AEG suit? The conspiracy against MJ continues?

Now what I said about Raymone through the years already and you all were like I should show some respect. I never respected her that much. Even thou she was a hard worker there was something fizzy in her. And she wasnt even professional or smart enough for Michael. She's in trouble now. I dont understand she wanted something like this from the work relationship with Michael... Its plain stupidity to get bitter after...

there is a bigger degree than a JD. it's called the degree of the dolla bill. it can turn any smart person into someone stupid.

Youre right. Something is missing. And its her brains, but she were never able to use them fully, so it doesnt really matter. She misses them but cant do anything about it. And it doesnt help if you went to Harvard or whatever, you can go crazy still...
 
Maybe Raymone thought with Michael being pre-occupied with the rehearsals/concerts, and the revolving door of managers or whatever you want to call them, she' slip through that door of opportunity and Michael/his legal reps wouldn't reply before the deadline.

Or if someone wants to get all conspiracy minded here, there could be others whispering in her ear to cause enough trouble that it might derail the O2 plans with a bonus for her from someone.

btw, could discussing and dissecting this cause a problem down the line? Could she come after anyone for defamation of character or anything?

Guess I shoulda been clearer. I figured there had to be some reason
they played it so close. And in the end, so it seems, it worked out...for MJ.

It makes u wonder doesn't it? I am really patiently awaiting her rebuttal to MJ's response because that has got to be really good. I already have an idea of what she may come up with but I am a bit too paranoid to mention it on the board.

And yes that payment and release statement is quite airtight. I do understand why MJ should use something so drastic as that; it is life-saving in effect for him. I'm just saying as a client etc. I would hesitate greatly in signing that statement.:) Because once you sign that, it is OVA!!lol.

Am I the only one who thinks she didn't know what she signed? I am guessing of course but think about it. She says suddenly Michael stopped communicating with her, etc. Suppose Michael (and Londell) knew he wanted to fire her. They both know she lets things slip through the cracks. Londell sends Michael the document to get Raymone to sign, Michael gets her to sign it, and then doesn't talk to her anymore. She doesn't even realize she is terminated and doesn't understand what is going on because she wasn't careful in reading through the document.

Even if she didn't realize what she signed she is going to look pretty bad if she comes back and says that. If she can't even handle her own business how is she going to handle Michael's? That would be incompetance. She may have been deliberately duped but it would be her own incompetance that let it happen. It is my guess that Michael himself agreed to things he shouldn't have when he was still recovering from the trial. Raymone took advantage of it and Londell (together with Michael himself) got him out of it by in turn going after her weakness.

I also think the staff around Michael protect him from being served. I always thought you had to hand the notice to the person themself and that is not necessarily easy. What the court thinks about that I don't know. I am not sure it is any worse than the agency that supposedly served him claiming that he was legally served however.

Mind you, I have no proof of any of this but it seems a much more likely scenario to me than that she knew this existed and still tried to sue Michael.

I reckon she didnt know what she signed untill the very last mintue. But when she realised what she done, she tried to hide it and pretend it never happened. So that way she was so sure she would be able to get the $$$!
 
Raymone Bain knew she had signed that form and she understood very well what she was signing. She is just trying to do what everybody else....Joe Jackson, DiLeo, Rowe, etc. is doing....position themselves under the money flow that is about to happen to Michael. Raymone had no idea that Michael was gonna get this huge deal with AEG and that is it was gonna be this successful right outta the gate. She was already released from her position and new feels that she should have been in on the action. That's all. She is looking at all those millions that are about to role in and is saying. "Damn"!
 
I think she had an idea of what she signed especially when it was sealed with $500,000 so to speak. And she is very much aware of this release form she signed. I just think she is going to find some way to explain it away (which won't hold any water).

second....this i sjust mj's response. this isn't the end. a judge has to agree to this and honor the agreement. remember the big hoopla and the fans julbaliant cries when they tried to say mj was being pushed to the brink of bankcruptcy etc...and a conspiracy etc? the judge didn't buy it and the cries of vindication were short lived.

third...allowing something to just default is a bad way to come off to potential litigants....for the future lawsuits taht WILL happen (*cuz he's mj*) it shows that it could get to this point so that's hella scary

fourth, what's up w/ the yaki? can't trish give her the name of that one site?

i don't understand the bolded part. what judge? which event are you talking about? although i have to say, that that judge probably thinks what quite a few(fortunately, not all)people think. that MJ is a fruitcake, and can't be taken seriously. just because a judge sits in a high chair, doesn't mean he or she is always fair. and just because some may find it easy not to buy a conspiracy, doesn't mean it didn't happen. you've said it yourself. operations in court aren't always kosher.

it never ceases to amaze me. that 'fruitcake' has lasted forty years through a sea of non fruitcakes that have come and gone. and that elementary logic, might register with children, but not always with some adults...including judges. maybe that's why MJ is happiest around children.

Reason for the delay in responding

In addition to the bombshell information I mentioned previously, Michael's side also explained the delay in response, and why the original notice of default should be tossed now that a formal response has been made within the allocated time the court provided.

According to the claim, Michael Jackson only became aware of this case on June 7th whereby he quickly acted to appoint the legal team he now has in charge of it. He was only informed of it through Frank Dileo who learned of it via the media, and never through a formal summons. Raymone alleged that a summons was given to a security guard and to Dr. Tohme Tohme, but none of them actually made their way to Michael. Dr. Tohme Tohme no longer has any personal nor professional association with Michael Jackson, nor did he at the time the original summons was served and he did not in any way communicate the information to Michael.

In addition, the lawyers state that "because of the existence of a valid and binding payment and release agreement between the parties, this action came as a complete surprise to [Michael Jackson]... Despite rumors and innuendos that may have surfaced before that date, Mr. Jackson did not conceive any lawsuit would be possible based on the payment and release agreement executed by Raymone K. Bain."

Michael Jackson submitted a signed declaration to these facts.

P.S., Also revealed and confirmed was the official termination of Dr. Tohme Tohme, which went into effect May 5th and disbarred him from having any subsequent affiliation with Michael Jackson or any of his numerous established entities (including MJJ Productions and the newer MJJ Kingdom).

The defense is also calling for the dismissal of Raymone's complaint based on the agreement she signed into which prevents her from profiting any further from Michael Jackson and contradicts her very claim.

what I don't get is that even with that, with the agreement, how Raymone could have felt thusly entitled, no mattter what she set into motion or what fell unexpectedly like diamonds from the sky in the form of 50 concert dates ... makes no sense, yes, like a puzzle piece is missing

key words for the bolded. 'unexpectedly, like diamonds from the sky.' this always happens with Michael. but, let's face it. a lot of the populace falls for the media gibberish about what MJ 'lacks'. and attention deficit, and loss of memory take over. every time he gets ready to do something, media comes up with a 'reason' why its not gunna go well. and lots of people fall for that. i think Raymone is one of em. i am sure she signed it, thinking MJ's gunna not do anything special. but then, special happened. it took Raymone by surpirse. and Raymone became Mr. Hyde.

and..oh..by the way, as we all know..it doesn't matter that special has happened in MJ's life again. this time around, the media jargon is..MJ's not gunna make it through fifty concerts. and, yes..a lot of people fell for it. Raymone probably thinks that, too. yet, still, fifty concerts is enough for Raymone to collect, early. maybe..in case, MJ...'doesn't make it through the fifty'.
