^^ If you mean the song copyrights, I wouldn't count on it. The unregistered tracks from Bad 25 didn't pop up until the track listing was announced.
I'm going to be pissed if they will be screwing up a simple thing as a good album cover. Don't they dare be "ashamed" of how Michael looked like in the recent years. He looks amazing in the Vogue photo shoot. I don't need to post all the pictures to justify this.

There's a pretty good chance that there will be at least one title we've never heard of on the album. There are dozens of songs that the estate hasn't yet registered, like DYKWYCA and A Place with No Name, and there could be dozens more that haven't been spoken of yet.

I prefer the L'Uomo Vogue photos to the Ebony ones. Michael looks more natural on them. Also the Ebony ones look photoshopped to me at times.
Michael looks gorgeous on TII but it'd make more sense his recent photo shoots were used because it looks more professional specially nice unseen pics. Maybe TII shoots could be used...

And we don't know if it's going on the new album. The ONLY songs that are set in stone to be released are A Place with No Name and Blue Gangsta.Songs like She Was Loving Me, Slave to the Rhythm, DYKWYCA and others are rumors from fans. The track listing is not even close to completed, so any song that we know of (even Chicago) may not appear.
