Metzger and his attorney were plaintiffs rebuttal witnesses. That attorney happen to be Debbie Rowe's attorney too, and plaintiffs" gave Debbies testimony to Metger to read so he can refresh "his" memory by reading Debbie's testimony.

I agree with you Big Apple, Metzgers testimony was reallyyyyyyy reallly bad and did nothing to help them.

Yes, the LAPD detective Scott Smith was also a rebuttal witness.

Was not he this witness in the murray trial who said he had erased the security records from Carolwood because there was not interesting on them? Only 4 minutes he had leaved. He said it was his own decision und he don't has had a permission for that from his superior. (if I rhight remember)

So, and now he is a witness for the Jacksons. brood over...

Detective Smith was called to successfully impeach Jorrie who said she did not tell the detective that Michael was going to do a world tour that would last two to three years when she did. He stated Putnam also said Michael would do a world tour. He also reminded the jurors that he was investigating the doctor, discovered he was financially troubled, and was concerned about the AEG employment contract.

So it takes a whole day to read the instructions to the jury? I wish the judge read the instructions in the morning and have the first closing argument after that. Maybe they are still on half day court. This case wasted a lot of time. Alan Duke said plaintiffs would call several rebuttal witnesses, so I am happy that it did not happen.

So that explain why the Jacksons are calling Smith.

It shouldn't take a whole day for jury instructions my friend who is going to court tomorrow in LA said court will started at 10:00am and sense it is going to be in a bigger courtroom which hold 200 ppls she is going early first come first server.

It will be alots of ppls there.

Pminton, I would be interested in hearing anything your friend wants to share about tomorrow's proceedings.

I typed out this one:

Instruction 302

Plaintiffs claim that AEG Live and Dr. Conrad Muarry entered into a contract or agreement. To prove that a contract or agreement was created, plaintiffs must prove all of the following:

1- That the contract or agreement terms were clear enough that AEG Live and Dr. Conrad Muarry understood what each was required to do;

2- That AEG Live and Dr. Conrad Muarry agreed to give each other something of value (a promise to do something or not to do something may have value); and

3- That AEG Live and Dr. Conrad Muarry agreed to the terms of the contract or agreement.

When you examine whether AEG Live and Dr. Conrad Muarry agreed to the terms of a contract or agreement, ask yourself if, under the circumstances, a reasonable person would conclude, from the words and conduct of each party, that there was an agreement. You may not consider the parties’ hidden intentions. If plaintiffs did not prove all of the above, then a contract or agreement was not created between AEG Live and Dr. Conrad Muarry.

Here is another

Instruction 306

AEG Live contends that it did not enter into a contract with Dr. Conrad Muarry because they had not signed a final written agreement. To prove that a contract was created, plaintiffs must prove the following:

1. That AEG Live and Dr. Conrad Muarry understood and agreed to the terms of the agreement; and

2. That AEG Live and Dr. Conrad Muarry agreed to be bound before a written agreement was completed and signed.

Instruction 517

AEG Live claims that Michael Jackson’s death was caused by his own negligence in connection with his medical care. To succeed AEG Live must prove both of the following:

That Michael Jackson did not use reasonable care to provide for his own well-being; and

That Michael Jackson failure to use reasonable care in connection with his medical care was a substantial factor in causing his harm.

Who will win: The Jacksons or AEG Live?

Well now that we are almost at the end of the trial, the jury have now received instructions and are only days away from deliberations I thought I would start this thread to get everybodys opinions on what they have thought of the case and what side they think will win.

Do you think the Jacksons have proven their case or not? Will AEG be found innocent or guilty?

and another typed by Junky on twitter

Affirmative Defense-Patient's Duty to Provide for His or Her Own Well-Being

A patient must use reasonable care to provide for his or her own well being.

AEG Live claims Michael Jackson's death was caused by his own negligence with his medical care. To succeed, AEG Live must prove both of the following:

That Michael Jackson did not use reasonable care to provide for his own well-being; and

That Michael Jackson's failure to use reasonable care in connection with his medical care was a substantial factor in causing his harm.

Comparative Fault of Decedent

AEG Live claims Michael Jackson's own negligence contributed to his death. To succeed in this claim, AEG Live must prove both of the following:

1. That Michael Jackson was negligent; and

2. That Michael Jackson's negligence was a substantial factor in causing his death.

If AEG Live proves the above, the plaintiffs' damages are reduced by your determination of the percentage of Michael Jackson's responsibility.

Appointment of Responsibility

If you find that the negligence of more than one person, including AEG Live and Michael Jackson, was a substantial factor in causing the death of Michael Jackson, you must then decide how much responsibility each has by assigning percentages of responsibility to each person listed on the verdict form. The percentages must total 100 percent.

No instructions on how the damages will be divided among the plaintiffs in case the greedy wins ?

Provided any juror believes Michael was a "secretive addict" that contributed to his own passing, it does NOT absolve AEG from allegedly and negligently hiring the doctor. It will only reduce damage payout.

From NY daily post:
"A big crowd — possibly including Prince — is expected for final arguments, so court personnel moved the proceedings to the much larger courtroom with more than 200 seats."

I wouldn't be surprised if KJ drags all 3 kids on court room to get pity votes from jurors.

Re: Who will win: The Jacksons or AEG Live?

Ummm, hmmm. I'm actually still not sure. Im waiting for the closing arguments. I think the Plantiffs have done a good job at getting as much in on the emotional loss as possible, Michaels music playing over the images would have been sure to pull on heart strings.

I think many witnesses have got off light in this trial, Karen Faye etc.

Although all the key points have been reported very well, I feel we have only got the basics on what has passed in that courtroom.

I think it's likely to come down to have much responsibility the jury put on Michael tbh.

One thing that won't change is the fact that the person who was ACTUALLY responsible for Michael's death will shortly be a free man in every sense of the word, and if Katherine wins a big payout I hope she feels it was worth it.

I bet closing statement from Panish will be far more heart felt and powerful than the pitiful impact statement he gave in the Murray trial. I guess there is more 'justice' at stake here. Smdh

Re: Who will win: The Jacksons or AEG Live?

we all lost when Michael died, so it's no win...and this trail was just about money, so I hated it from the beginning...the only good thing that came out of it is that we could see how much Michael suffered and still how sweet and caring he remained until the last day of his life:)

honestly, AEG should pay because they were negligent in hiring Murray that had no expertise in what Michael needed and he was such an incompetent to leave someone alone under anesthisia...but I don't want the Jacksons to receive any money, they shouldn't cash on Michael's death, they exploited him enought when he was alive...so I will not be able to decide what verdict I would prefer!

Don't be so sure about Jacksons winning even $ 1.00. We all remember all the hype about Snedon winning his case. I'm very positive Jacksons will regret their shame very soon.

Re: Who will win: The Jacksons or AEG Live?

I don't know but I hope common sense wins over greed.
