LOS ANGELES (AP) — A judge questioned two alternate jurors in the civil trial over Michael Jackson's death after a woman approached them and told them not to award the singer's family any money in the case.

Superior Court Judge Yvette Palazuelos and attorneys on the case questioned the alternates, who said the woman approached them during a break Friday afternoon. Both said the woman told them not to award any money in the case against concert promoter AEG Live LLC.

The alternates said they told the woman she couldn't talk to them, but she persisted for several moments before finally leaving them alone. They described the woman but said they did not see her in the courtroom after testimony concluded Friday.

The alternate jurors said their interaction would not affect their judgment about the case. The judge told them to return to court Monday and report to bailiffs or court staffers if they saw the woman again.

Jackson family attorney Brian Panish said the interaction was jury tampering and is a felony.

Katherine Jackson mother is suing AEG Live over her son's death. The company denies wrongdoing.

The case has five alternate jurors remaining after one had to be dismissed because he is moving out of state.

LOS ANGELES (AP) — Michael Jackson's longtime stylist told jurors Friday that she tried to warn the singer's manager that concert promoter AEG Live LLC would look responsible if the singer died because of numerous signs his health was declining.

Hair and makeup artist Karen Faye testified about two emails she sent to Jackson's manager Frank Dileo within the five days before the singer's death that his health was deteriorating. In one of the messages, Faye warned Dileo that he and AEG Live CEO Randy Phillips might become "villains" or "financial victims" if Jackson were to die while preparing or performing a series of comeback shows called "This Is It."

Faye said she struck a dire tone in the messages because she felt that earlier concerns about Jackson's health had been ignored.

Faye sent the warning that Jackson may die in a message on June 20, 2009 — five days before the singer died of an overdose of the anesthetic propofol. Two days later, on June 22, she sent the warning about Dileo, Phillips and tour director Kenny Ortega being held financially responsible for the entertainer's demise.

"I don't think you, Kenny, or Randy deserve becoming the villains, or the financial victims," her email states. She wrote that the message was "between you and me alone."

She told jurors she was concerned the men "could be responsible for that in some way. Just kind of like where we are right now," she said, referencing Katherine Jackson's ongoing civil case against AEG Live.

Ortega was initially sued by Jackson's mother, but was dismissed from the case.

Faye's emails described Jackson as emaciated, paranoid and unable to perform. She told jurors Friday that while the singer's performances dramatically improved in his final two rehearsals, she was still not convinced he would be able to perform the 50-concert schedule of "This Is It," let alone its premiere.

Katherine Jackson claims AEG executives missed signs about the singer's health and failed to properly investigate the doctor convicted of administering a fatal dose of the anesthetic propofol.

AEG denies it hired Conrad Murray, the former physician convicted of giving Jackson an overdose of the anesthetic propofol. The company also denies it pushed Jackson to rehearse.

Faye told jurors that she was never pressured by AEG executives Randy Phillips or Paul Gongaware to get Jackson to rehearse.

The stylist testified earlier in the trial that she overheard Gongaware tell Jackson's assistant to get him out of a locked bathroom and to a rehearsal. Gongaware denies that conversation ever happened.

LOS ANGELES (KABC) -- Karen Faye, one of the people closest to Michael Jackson, was back on the witness stand Friday to undergo cross-examination in the Jackson family's wrongful death trial against concert promoter AEG Live. Faye was Jackson's hair stylist and makeup artist for 27 years.

Faye testified about warning AEG execs that Jackson was too thin a month before Jackson's comeback tour was to launch. She told jurors when she first testified seven weeks ago that a costume fitter told her that Jackson was so thin, his heart was visibly beating under his skin.

Now under cross examination by the AEG attorney, details emerged that rebut many of her earlier statements. Defense attorney Marvin Putnam asked Faye if she would be surprised that Jackson weighed 136 pounds when he died.

Faye's response: "136 pounds would be good for Michael."

Faye had testified, too, that she was scared for Jackson on June 19, saying six days before he died, he was shivering and unable to rehearse. Three days later, Jackson was back on stage doing Billy Jean.

Putnam asked Faye how Jackson's performance was on the 23rd.

Her response: "It was much improved."

Putnam asked, "Did it restore your hope?"

Faye replied, "Oh yeah."

Faye qualified her answer by saying she still thought the concert schedule was too strenuous. The defense showed jurors a calendar that said 10 days a month max, as few as three, with a break after three months, and Jackson would not have to travel. He would stay in one arena.

Katherine Jackson and the star's three children are suing AEG execs Randy Phillips and Paul Gongaware. The Jackson family alleges that AEG hired and then failed to supervise the doctor who was treating Jackson nightly with a surgical anesthetic to help the singer sleep. Jackson died from an overdose of propofol.

The plaintiffs say that Jackson's anxiety was generated by the tour promoters. The defense asked Faye directly if Phillips or Gongaware every personally pressured her to get Jacskon on the stage. Her answer was no.

Los Angeles (CNN) -- A business management expert testified Monday as lawyers try to prove Michael Jackson's last concert promoter is liable in the singer's death.
Human resources consultant Jean Seawright's analysis of AEG Live's hiring practices may lack the drama of last week's testimony by Jackson's oldest son, but it could be crucial for proving that the company negligently hired, retained or supervised Dr. Conrad Murray.
The trial of the lawsuit filed by Jackson's mother and three children began its tenth week with their lawyers nearing the end of their case. AEG Live lawyers are expected to start presenting their defense around July 15.
AEG Live contends that Michael Jackson, not its executives, chose and controlled Murray, who is serving a prison sentence for an involuntary manslaughter conviction.

If the jury decides that AEG Live executives have responsibility for Jackson's death from an overdose of the surgical anesthetic propofol, they will then have to decide how much he might have earned in the years he didn't get to live.

Jurors would have learned a lot about Michael Jackson's work and worth if they had traveled with the Jackson family to Las Vegas over the weekend for the premiere of Cirque du Soleil's "Michael Jackson One" show.
Prince, 16, and Blanket, 11, sang and danced while watching the Cirque celebration of their father's music and life in a Mandalay Bay Casino theater. Paris, 15, was unable to attend because she is still hospitalized since last month's suicide attempt.
The children never saw their father perform live, one of his motivations for attempting his comeback concerts, but thanks to technology Jackson appeared to be back on stage for a ghostly performance of "Man in the Mirror."
Prince's appearance at the opening of the permanent show, which is different from Cirque's traveling "Immortal" show, came three days after he appeared in court to tell jurors about his father's life and last days.
His father often cried after talking to AEG Live executives as he prepared for his comeback concerts, his oldest son testified Wednesday.
"After he got off the phone, he would cry," Prince Jackson testified. "He would say 'They're going to kill me, they're going to kill me.'"
His father told him he was talking about AEG Live CEO Randy Phillips and his ex-manager, Dr. Tohme Tohme, Prince said.
Negligent hiring?
Seawright, who has worked as a human resources consultant for businesses for nearly 25 years was paid $300 an hour by Jackson lawyers to review documents and testimony on the wrongful death case. After about 100 hours, she said she reached an opinion about if AEG Live's hiring of Dr. Murray was negligent.
"They did indeed fail to follow adequate hiring practices," she testified Monday.
Serving as a personal doctor for Michael Jackson was "a very high risk position" that warranted a background check to determine if Murray was fit for the job, competent to do the work and did not have a conflict of interest, Seawright testified.
Jackson lawyers contend that Murray's deep debt, which included $1 million in foreclosures and judgments, made him conflicted since he could lose his $150,000 a month job if Jackson didn't make to rehearsals and perform his concerts.
A simple credit check -- taking five minutes and costing less than $10 -- would have revealed the conflict of interest, she said.
Credit checks are routine for many companies hiring for high-risk positions, she said.
A key piece of evidence used by the Jackson lawyers is an e-mail sent by AEG Live CE Randy Phillips to "This Is It" show director Kenny Ortega on June 20, 2009 -- five days before Michael Jackson died from an overdose of propofol administered by Murray.
"This doctor is extremely successful (we check everyone out) and does not need this gig so he is totally unbiased and ethical," Philips wrote in an effort to assure Ortega Jackson was in good hands with Dr. Murray.
Seawright testified that she found no evidence the company did anything to check out Dr Murray for fitness, competence or any conflict of interest that might lead him to provide unsafe treatments.
AEG Live argues that it never hired Murray, but simply negotiated with him on Jackson's behalf.
Seawrght said companies have the same obligation in hiring, whether for a regular employee or and independent contractor.
Jury tampering?
Jurors can expect to be watched more closely by court bailiffs after an incident near the end of Friday's session. Two alternate jurors told the judge that a woman approached them during a court break.
"She mention 'Please don't give anyone any money,'" alternate juror No. 1 said.
Alternate juror No. 5 quoted the woman, saying "I just wanted to say not to award them any money."
While the woman apparently was opposed to the Jackson's lawsuit seeking billions of dollars in damages, AEG Live lawyer Marvin Putnam used the incident to suggest that the judge should crack down on Michael Jackson fans who wear Jackson shirts and carry signs of support for Katherine Jackson in the court hallway.
Los Angeles County Superior Court Judge Yvette Palazuelos rejected Putnam's request, saying Jackson fans have free speech rights that she cannot limit.
Both alternate jurors said the incident would not affect their ability to make an impartial decision in the case.

AEG didn't properly check Conrad Murray's background, witness says

Entertainment group AEG did not properly check Dr. Conrad Murray’s background before bringing him on board for Michael Jackson’s ill-fated “This Is It” tour, a human-resources consultant testified Monday.

Jean Seawright, head of the Florida-based Seawright & Associates consulting group, said that based on her review of the case, AEG Live “did indeed fail to follow adequate hiring practices” in the selection of Murray, regardless if he was considered a company employee or independent contractor.

Seawright, an expert witness retained by the attorneys representing Jackson’s mother and three children in their wrongful death lawsuit, said her testimony came under the assumption that AEG hired Murray, who gave the singer a fatal dose of the anesthetic propofol in 2009. The jury will ultimately determine which party retained the doctor. Jackson’s family alleges AEG hired and controlled Murray, while AEG maintains he worked for Jackson.


Murray is serving time in prison for involuntary manslaughter.
Seawright called the role of Jackson's personal physician a “very high-risk position” given the responsibilities of the job – such as accessing the singer's medical history and personal life, working remotely and providing medical care.

Companies following appropriate hiring practices assess the risks of a position before hiring, she said. When asked by Jackson family attorney Brian Panish if she thought AEG had done so in this case, Seawright said she “saw no evidence of that.”

Seawright then testified about an email from AEG Chief Executive Randy Phillips to tour director Kenny Ortega, in which Phillips said Murray was “extremely successful” – noting “we check everyone out” – and “does not need this gig, so he is totally unbiased and ethical.”

Seawright said that email indicated Phillips understood the criteria for the job and that AEG had a process in place for examining its workers. When asked if she saw evidence indicating the company in fact “checked out” Murray’s background, she replied: “I did not.”

Ultimately, she said, the email indicated AEG was in a "sort of trap … where if you don’t check out a worker adequately, then you are in a situation like this.”

“It was Mr. Phillips saying what he hoped was the case but we later found out was not the case,” she said.

LOS ANGELES (KABC) -- In the Michael Jackson negligence lawsuit, an issue of race entered the courtroom and sent off fireworks between the attorneys on Tuesday.

It happened as Jean Seawright, a human resources expert, testified in support of Katherine Jackson's claim against concert promoter AEG Live.

Seawright stated that if AEG hired Jacksons's doctor, Conrad Murray, AEG should have conducted a credit check on him. The defense challenged her. Attorney Jessica Stebbins Bina asked whether a credit check might violate federal law.

She cited a statement from the Equal Employment Opportunity Commission, or EEOC, that says inquiries about an applicant's credit rating, charge accounts or bank accounts generally should be avoided because they tend to impact more adversely on minorities and females. A debate erupted.

Outside the presence of the jury, attorney Brian Panish for the plaintiffs, said, "She said it is law. This was not a law. The jury is going to be confused."

At least nine jurors are women or members of a minority group.

Another Jackson attorney chimed in, saying, "It is a sensitive point given that many members of the jury are of a protected class."

The judge responded, telling jurors that the EEOC statement was a guideline, not a law or policy.

The plaintiffs allege that Murray, hired for Jackson's tour, needed money so badly he agreed to Jackson's request for propofol, a substance that caused Jackson's death.

LOS ANGELES (CBSLA.com) — A new witness took the stand Tuesday in the Michael Jackson wrongful death trial.

Drug addiction specialist Dr. Sidney Schnoll told the jury many times an addiction can be cured if a doctor gets to the root of the problem.

Dr. Schnoll is an expert witness for the plaintiffs.

According to the Jackson family attorney, he will testify that instead of finding out what was wrong with Michael Jackson in the weeks and days leading up to his death, the singer’s doctor, Conrad Murray, instead kept him over-medicated, ultimately giving him an overdose of the powerful anesthetic that killed him.

Michael Jackson’s mother, Katherine Jackson, is suing concert giant AEG Live for negligence. The matriarch claims executives hired, retained or supervised Murray while the singer was preparing for his This Is It comeback tour.


The firm insists Murray was hired only at Jackson’s request.

A human resources expert for the prosecution also finished her testimony Tuesday.

Jean Seawright told jurors AEG “did indeed fail to follow adequate hiring processes” when dealing with Murray.

She testified had officials at the firm done a credit check on the physician, executives would have seen he was deeply in debt and might have been motivated by his $150,000-a-month salary and not his patient’s well-being.

Attorneys for AEG produced guidelines from the U.S. Equal Employment Opportunity Commission (EEOC) that said financial background checks on potential employees can be discriminatory and to use caution before doing them.

Murray is currently serving a four-year sentence for involuntary manslaughter at an L.A. County jail following his conviction in Jackson’s 2009 death.

LISBON - Two Wellsville area women - the widow and daughter of one of the late pop star Michael Jackson's managers - found themselves in Columbiana County Common Pleas Court Wednesday morning facing contempt of court allegations.

According to court documents, Linda Dileo, the widow of Frank Dileo, and their daughter, Belinda Dileo, have been requested by subpoena to turn over the laptop computer and cell phone of Frank Dileo, who died in August 2011. However, they have both failed to do so, prompting the contempt motions.

The electronic devices are being requested by Jackson's mother, Katherine Jackson, and the children of Michael Jackson, who are currently involved in a civil trial in Los Angeles about Jackson's death. In that suit, Jackson's family members are claiming the wrongful death of the music star while he was preparing for the "This is it Tour." The lawsuit has been filed against AEG Live LLC and others involved in Jackson's career near the time of his death.

The Jackson family involved in the lawsuit reportedly is hoping to find emails or documents related to the health of Michael Jackson between Jan. 1, 2009 and June 25, 2009 - the date of Jackson's death.

Local attorney David Tobin was requested to take a deposition from Linda Dileo on behalf of a request from the California Superior Court in February. A motion was filed in March on behalf of Linda Dileo to quash the subpoena, which was followed by a motion to compel her to give the deposition. Finally, on May 28, the deposition was taken.

According to court documents, Linda Dileo testified the laptop being sought by the subpoena was given by her daughter to a friend. She agreed to attempt to locate the computer in the next seven to 14 days and hand over the cell phone immediately. However, neither has been turned over.

Additionally, Belinda Dileo reportedly failed to answer in her deposition any questions regarding whom she had given the laptop computer. William Bloss, an attorney for Koskoff, Koskoff and Bieder of Bridgeport, Conn., representing the Jacksons, said he would be willing to not learn the name of the person who has been holding onto the laptop provided when they receive the computer it has not been tampered with.

A computer expert, David Wilkeson of Tech Advisor LLC of Canfield, has been hired by the Jackson contingent to review the laptop and possibly the cell phone should they be provided. He testified on Wednesday how he would make a mirror image of the contents of the laptop without jeopardizing the data.

Wilkeson, who agreed to sign a confidentiality agreement, said he would be able to create read-only files from the contents of the laptop and search them for keywords or names. Wilkeson said he has a background in doing similar work for local police in cases involving white collar fraud and child pornography.

Bloss pointed out the Jackson family has concerns about items on the laptop not being disclosed because it should be privileged information.

Attorney Chris Amato, recently asked by the Dileos to represent them in court, said the family also has concerns about the contents of the computer and cell phone, noting these are personal items of a deceased family member. Frank Dileo reportedly was using these items when helping Jackson prepare for the upcoming tour, which never occurred due to his death.

Amato questioned about the chances of the computer's contents being destroyed, erased or revealed.

"They don't have any safeguards," Amato said.

Wilkeson said the only chance of a problem is if the computer would fail electronically while he was pulling the copies of the contents from it.

Amato also said the women have told him the cell phone was given to attorney Carolyn Dorazio of Wexford, Pa., who at one point served as the attorney for Belinda Dileo.

Tobin said obtaining the laptop and cell phone has been "like pulling teeth, as the court can see from what has taken place." He further requested Linda and Belinda Dileo be found in contempt of court and if they failed to produce the items by Friday, they should be incarcerated until they produced them.

Bloss added time is growing short. After the hearing, Bloss said the civil lawsuit in Los Angeles started about two months ago and testimony on behalf of Katherine Jackson and the children is expected to continue for another week or two. Then the testimony on the side of AEG and the other defendants is expected to take at least six weeks.

Judge Scott Washam agreed to find both Dileo women in contempt, despite an objection by Amato that Linda Dileo had offered and done everything in her power to produce the laptop but it is not in her possession. Washam gave the Dileos until Monday to produce the two items so their attorney can get them to Wilkeson. Doing so would purge them from the contempt.

Another hearing was set for Wednesday, July 10 to ensure the order to produce the items is followed.

AEG Live Entertainment LLC also had an attorney in the courtroom, Richard Buckner, who only spoke up once when he believed a comment made by Tobin about an email may have accused his law firm, O'Melveny and Myers LLP of Los Angeles, of "game playing."

According to court documents, O'Melveny and Myers represented the Dileos in earlier court proceedings.

<!-- STORY STARTS --><!-- context: top --><!-- pass -->The personal computer of Michael Jackson&#8217;s late manager, Frank DiLeo, will be handed over today by his daughter in the hope of finding a &#8220;smoking gun&#8221; about the star&#8217;s death, sources tell Page Six. Lawyers for Katherine Jackson and her three grandchildren hope the hard drive contains evidence that will prove that executives for concert company AEG Live were responsible for *****&#8217;s 2009 death by hiring Dr. Conrad Murray, who gave him a fatal dose of medication.

The Post&#8217;s Richard Johnson reports that Katherine&#8217;s lawyers subpoenaed the computer before the wrongful-death civil trial started in April, but were stymied until an Ohio judge found Frank&#8217;s daughter, Belinda DiLeo, in contempt of court last week and vowed to jail her if she didn&#8217;t produce the computer by today.


&#8220;First she said she didn&#8217;t have it, but then she miraculously found it, and she&#8217;s handing it in on Monday,&#8221; a source told The Post.

The cigar-smoking, bullet-headed DiLeo was so convincing as a gangster, Martin Scorsese cast the Pittsburgh native in &#8220;Goodfellas.&#8221; The jury is already familiar with him from testimony of Michael Jackson&#8217;s hair and makeup person, Karen Faye, who said she overheard DiLeo dealing with the artist&#8217;s severe weight loss by telling a handler, &#8220;Get him a bucket of chicken!&#8221;

AEG Live boss Randy Phillips testified that he and DiLeo were standing in the emergency room at Cedars-Sinai when they were told Jackson was dead. &#8220;Frank collapsed,&#8221; Phillips said. DiLeo died two years later, following heart surgery at the same hospital, but he didn&#8217;t take his secrets to the grave. DiLeo left a manuscript of the tell-all he was writing. &#8220;The truth has to be told,&#8221; he said at the time. &#8220;I&#8217;m going to set the record straight once and for all.&#8221; It is in the hands of Mark Lamica, who worked with DiLeo for nine years.

&#8220;Frank knew where all the bodies were buried,&#8221; said an insider. &#8220;If there are new e-mails on his computer, or a copy of his book, it could rip the trial wide open.&#8221;

But AEG lawyer Marvin Putnam told The Post, &#8220;Unfortunately, this is yet another attempt by plaintiffs to distract the press with a sideshow.&#8221;

Putnam said he and his clients &#8220;look forward to the production of Frank DiLeo&#8217;s computer. Mr. DiLeo&#8217;s documents will only confirm what the defendants have said all along &#8212; that the defendants were never aware that Dr. Conrad Murray was administering powerful anesthetics to Michael Jackson in Michael Jackson&#8217;s private bedroom at night behind locked doors.&#8221;
