I'm not mixing up cases, i was replying to your post suggesting repressed memories cdn't be used in civil cases. Repressed memories have been used in a civil trial for sexual abuse. I found one just by a quick google from 2012.You are mixing up the nature of the cases. Here the claim is sexual abuse and Wade is trying to sue a dead man's Estate for it. Catholic church is sued for negligence. Not only entities can be sued to until the plaintiff is 26 yrs old but CA at least once passed a temporary bill to allow such negligence lawsuits against entities.
And yes i agree with what you say - that the estate is probably meaning that repressed memories haven't been used in a case against a dead person.The ten woman, two man jury found the defendant Fr. Kelly liable on multiple counts of assault and sexual abuse, based on the victim's testimony of his recovered memories.
