Anka did not complain for the decades those two songs remained untouched that I am aware of.
Estate/Sony has a strong need to placate Anka for Michael's wrongdoing (if one wants to call it that). After LNFSG, Anka should be fairly compensated and McLain can enjoy other songs from Anka outside of Michael's pending posthumous releases.
That's not what was said. Anka said that when Michael and him recorded the songs together, Michael took the master tapes from the studio. Considering that they were recorded in Anka's home studio, and Anka (I'm presuming) pays for the recording equipment and tapes and whatnot, Michael should have asked before he walked out with them. So Anka has every right to say what he said.
