Katherine Jackson Can Challenge Administrators

I think this is a HUGE win for MJ's estate and a huge loss to Sony in terms of getting their filthy hands on that ATV catalogue. Katherine will have Michael's, his childrens, and her own best interests at heart and that would be to keep that catalogue as it is a major source of revenue!

there is a HUGE CONFLICT OF INTEREST between katie and mj's kids . she had her children best interest which is totally against mj's kids and estate best interest .
the siblings want to liquidate the estate, they want to sell everything so the money generated will be considered profits and the executors have to distribute it to beneficiaries . they want to liquidate the estate as soon as possible because they are racing with time , katie is an old woman and once she leave this earth the siblings lose their only means to mj's estate.
they don't want 40% of the profits which are minimum because the executors are focusing on paying debts ,taxes and expanding the assets. they want to maximise the profits distributed and that could happen only if the assets all are sold .


Branca and co are getting 3 % of all the deals the estate is making , the sony/atv along with the other assets are bringing hundreds of millions , it is in his best interest to keep the estate's assets and even expand them , also it is the best thing to happen to the kids and charities who are long term beneficiaries , the only one who is not benefiting from this strategy is the jackson family .

in his will mj made sure his mother is a short term beneficiariy, he made sure his estate is going to take good care of her and after she dies the money goes back to his kids , that's why she is getting 40% of the profits only but the siblings think now they are entitled to 40% of the estate and they are making sure they are going to end up getting 40% of his estate.
 
ofcourse they have a plan , they did not object , so you would think they are onto something . remember before with the memorabilia deal , the family fans were expecting bombshells from katie and she ended up sending Randy ,rowe and another thief the jacksons sued before for fraud in the 80th . the jacksons made a joke of themselves in that court room .

Branca knows exactly how predictable they are , have you heard mj tapes , he even said his brothers were very uncreative and waited for him to deliver ideas . they want the money and they don't understand how much creepy , greedy and screwed up they are looking .

based on londell's email, it looks as though katherine juts would like more communication between herself and mcclain and branca. the threat is now there that she can have them removed or have someone come in and watch them. maybe now they'll be more open w/ her and take her feelings into consideratoin when doing things.

y approve and push another aeg project? memorablia? they had a hand in killing mj. they did nothing. now the movie is a way for everyoen to see what mj was planning, i get that but anything else aeg sponsored is freaky and y the hell are they even involved w/ the estate after tii?

she can not remove them when she wants. It's the judge's decision only and she have to prove why she wnats to remove them. Don't forget that Branca & McClain didn't object. It's the most interesting.
 
right, im saying she can go forth and threaten...but it looks as though mcmillian is saying things may blow over w/o her pushing forward.

maybe this can bring them all together. it doesn'tneed to go to litigation, we don't need to make a mess of this, we need to work together

do the admin's stay on after the kids are no longer minors? like when jr is 18 can he ask to be put on?
 
Lawyers acting for the Jackson family matriarch claimed a significant victory after the hearing, late on Friday afternoon, at which they asked the judge to allow her to challenge the administrators without invoking a “no contest” clause in her son’s will.

Los Angeles Superior Court Judge Mitchell Beckloff ruled that such a challenge would not cause her to be disinherited of her existing 40 per cent stake in the estate.
Mrs Jackson’s attorney, Londell McMillan, said later: “We now hope to resolve the administration matter in the best interests of the beneficiaries, Mrs Jackson and her grandchildren.”

A source close to the family said yesterday: “This was the first, and most difficult, step to the Jacksons seizing back power from the trustees.

“They believe they have the showbusiness acumen and infrastructure to optimise growth of Michael’s wealth.

“Is this a power ­struggle? Plain and ­simply, yes.”

Among differences ­between the family and the trustees are plans to open the singer’s former home, Neverland Ranch near Santa Barbara, as a museum, theme park and live music venue.



Family members, led by the late Moonwalker’s brother Jermaine, are determined to build an “eternal shrine” that will also be a revenue source.

San Francisco-based investment company Colony Capital, which owns the Neverland title deeds, is in favour of the plan.

The Sunday Express can exclusively reveal that unnamed developers made an application to the US Patents and Trademarks Office ­regarding Neverland, as soon as ­August 12.

Jackson died after a deadly drugs cocktail at his ­rented LA mansion on June 25.
Another option is a Jackson-themed casino and leisure complex in Las Vegas, where the star lived for 18 months, and where Colony Capital owns a site on the Strip.
“Basically, they want something up and ­running as a revenue source by early next year,” said the family friend. “But the trustees are much more hesitant.
“Jermaine is so keen to get going, he even ­believes Neverland could be opened for Christmas, and would ­become an instant mecca for fans of Michael, just like Graceland is for fans of Elvis.”

At least two siblings are, however, horrified by the idea of opening Neverland because Jackson vowed never to return ­after his 2005 child ­molestation trial.
The family source said: “It’s an issue which is completely dividing the family. But the one thing they are all unified on is Katherine’s fight to wrest back control from the ­administrators Michael named in his will.”

The source close to the family is a joke. The executors didn't object and the family have to prove that they are unfit to manage the estate.

I think that the attorney for the kids also have a say in these matters.

she better have a say and neverland is never again. it's jermaine pushing and katherine listening which is WHY mj never wanted his family mixed in w/ this. he gave them money. let the experts run this
 
Katherine should have a saying in the business but the administrators should remain the ones Michael named!
 
the problem are Joe, Randy and others who think to have rights on the estate
 
well well , it is not a significant victory as the stupid lawyer is trying to claim , infact "Undue Influence" is the most common ground for will contests and the burden of prove is on katie and her family , they have to prove that mj was not able to change his will for at least the last 12 years .

maybe katie thinks the executors are terrified and may try to set with her and allow Randy as a third executor before the court hearing but obviously they did not even object , they know it is impossible to prove that mj was unable to change his will for 12 years .

but they also know how much damaged the family will seem after this fight with the executor ends, how greedy and shameful, and their dirty tactics will also be revealed soon .\


the only way for the jacksons to remove Branca is by claiming mj was totally unfit mentally all these years . remember MJ stopped working with Branca at least two times during the last 12 years , but still he did not change his will or create a new one . HOW POSSIBLY THEY ARE GOING TO EXPLAIN THAT ?
 
they are challenging based on "undue influence" , MJ's ability and judgement are going to be put on trial nothing else . reread the judge words , he is allowing her to contest the will based on the "undue influence"
 
and now joe is saying prince told him he saw needle marks on mj , so I won't be surprised at all if the family pushed the kids to testify that mj was unfit all the time . IT is indeed their only argument .

they have to prove mj was under psychological domination by Branca which resulted in an excessive benefit to Branca . they then have to prove how mj fired Branca two times and yet did not change his will for 12 years . in other words they have to prove Branca psychologically dominated MJ for the last 12 years of his life .
 
Ok, I was giving the family the benefit of doubt up until this point, but I'm really beginning to have other thoughts now. Notice how McMillan put out a "message" about an agreement right away. If Branca is as devilish as they claim, they're certainly willing to make a deal with him...

the AEG project did bring millions to the estate, the jacksons were asked to present their case regarding that issue, Katie's lawyer wanted to broke a deal with a starting up company in the middle east instead of the professional AEG, the judge WAS MAD when they presented that offer and said that was the last thing mj's estate needed .

they are not angry because of AEG , they are using the AEG "killed mike" as an excuse to blackmail the executors into signing with companies brought in by the siblings and joe. unprofessional companies that pay them under the table , and screw MJ and his kids as long as everyone else is getting paid throughout the process .

wake up people , joe is still insisting mj first signed a deal for 10 concerts , we had the contract he signed for 31 concerts , they want to sue AEG , they are shifting the focus from MUrrya , murray is no longer in the news, it is the conspiracy theories that everyone find laughable but some fans . Murray killed mj and he should pay but the family has been portraying mj as a drugged up , totally insane person since his death . they are going to testify as hostile defense witnesses in the case against murray , and i'm afraid the prosecutors ay feel that if his family is acting like that and many of them will end on the defence list , their chances of successfully prosecuting murray are really zero.
 
branca knows well the family and their antics. he's not afraid of their "undue influence". He can easily proove that they are not fit to manage the estate.
 
I have no doubt whatever that katie will only embarrass herself and the family will again look like a money hungry free loaders who think mj owed them everything under the sun . they won't get what they want . the executors won't be removed , Randy won't at all be appointed as a third executor. damn the judge refused even to let him testify that tells you something right?


the problem now is they are going to make mj look like the most insane person in the last 12 years of his life in their attempt to get hold of his estate, that will be a nightmare for the kids and the fans . and certainly it will be a huge HUGE obstacle the prosecution will face in an upcoming trial against Murray .

I'm afraid Murray might walk out becasue of the family greed , they have already forgiven him because he has no money .
 
and soso deaf , would you please explain to me why Randy Philips was at mj's funeral if indeed the jacksons feel AEG killed MJ ? do they suffer from selective memory disorder ? I mean when it fits them AEG are killers, and the next day they forget everything.

How could Katie allow the company who killed her son to organize his memorila, how could she invite the people who killed him to his funeral ?

this is another prove that they don't really "want justice" they want the estate .

if i were them i would be on tv talking about my brother illnesses , about his diseases , what made him took those drugs , why he suffered from insomnia, i'll tell the world that the insomnia was something he suffered from since he was a child touring with the brothers , i would tell the world it was not a new thing , all they are doing is painting him as this totally insane man who had no control over anything in his life .i'll be speaking against Dimon, against Ian halperin , against lester , against klien , I won't feed the tabs stories about him , i won't back up lester and kliens fabrications ...etc .
 
they are the people responsible for protecting mj's legacy , but all they have been doing ios completely destroy his image and legacy . I can't imagine what they are telling those kids everyday, the stories they are feeding them about their father . some of the siblings did not feel they were obligated to cater for their own children , it is really hard to believe that they believe the money should go to those kids when must of them don't or refuse to believe they are his kids .
 
now things are more and more complicated. kids will suffer a lot in the future. I just hope Katherine can take good care of them.
 
you know what I hope the fight for the estate will take as long as possible , why? because 80.000 $ is much more than enough for four people , the kids especially getting 60.000$ is very good , as long as the estate matters are not settled the beneficiaries won't get a penny as profits, the kids allowance are more than enough, the jacksons won't get a penny . and when the kids are of legal age things will be much easier for them , the judge appointed a guardian to look after their financial matters, katie will be forced to provide documentation of where the money is spent , the judge asked the guardian to present to him a report on how the kids are coping since their father death , so if the kids have any complains we and the whole world will know . keep the jacksons under pressure , that's the only way they keep taking good care of the kids while keeping their mouths shut about mj .prince and paris won't tolerate any bad word about mike from anyone.

as long as the estate is in probate , no profits are going to be distributed , if indeed Katie proved mj was unstable for 12 years , then he was unstable when he appointed her as a guardian , and when he gave her 40% of his estate profits as long as she is alive . under the law everything will come into question, she will lose the right to those profits and mj's only heirs under law are Prince , paris and Blanket , she will be out of the will . I doubt that what she wants , but if she went that road she must be prepared for the worst .

katie will pay the lawyers out of her allowance , she may ask the judge for the estate to pay for the lawyers but that's highly unlikely . the judge seems very frustrated with her lawyers and he told them before he was not imperessed at all with their endless list of motions . he knows if he allows her to use the estate to pay for the lawyers , she will send them to fight for every little and big thing .

at some point in the near future the attorney's will ask to be paid and then katie will face the music .

we are discussing what the family will say in challenging the executors, they have already said they are basing the challenge on "undue influence" which means mj will be put on trial not the executors , he will be put on trial and the world will hear what the family thought was wrong with mj for at least the last 12 years of his life .
