the thing about the highlighted part is several people: the chef, Lou Ferrigno, the Vegas nurse, people unconnected to AEG say MJ was fine and dandy dancing exercising etc so was not "under undue influence" we have lots and lots and lots of paparazzi pics taken every week or every other week of MJ up and about in LA those pics started in April after his announcement of the tour so clearly he wasn't "under undue influence" since he was out and about happy go lucky clearly an indication of someone who has his free will. MJ had the AEG (from the major main owners to Randy Philips) meetings ALL by himself with Thome Thome in LA.... Branca wasn't part of that at all and during that time there were lots and lots of reports of MJ being up and about in Las Vegas and LA and recording with several different artists from Akon to Will.I.Am etc etc... during that time he was with Peter Lopez and previous to that with Raymone everyone during that period said MJ was in perfect condition and infact Londell McMillan was in the picture and clearly he didn't think MJ was under any influence?
MJ was recording the rehearsals, he may have had all the negotiations recorded too who knows.... it will be real difficult for Mrs J's team to concretely prove MJ was under undue influence they can't use the "i have a feeling" "i suspect" "it was rumored" "someone mentioned" kind of evidence/excuse. They would have to show real proof of that actual evidence of MJ strung out unable to comprehend anything etc... They can't use the "MJ was on drugs" excuse either since everyone claims to have had no clue that MJ was doing that and it seems he was only using Murray for a sleeping disorder issue and hence the drugs found in his body at time of death had all been injected by Murray and caused his death and they can't surely use that to say MJ "undue influence" since he got his "sleep issues" done at night and during the day conducted his business just fine.... in fact he was with the family at his parents 60th marriage anniversary and none of them thought he was on drugs then... in fact Joe and Rowe and Mrs J also met with MJ after that for a "business meeting" at the Beverly Hills and even then none thought MJ was under drugs so it will be hard to carry that....
Its a very fine line saying "we think MJ may have thought X and not Y" without concrete supported documents or proof. So my real hope is that Mrs J's lawyers have all this information and that it will come out in the clear. They also can't claim "conflict of interest" for Branca re: Sony because ALL the while MJ worked with Branca more than 20 yrs, Branca worked with him on consultancy basis not on exclusive basis and thus was allowed to have other clients and MJ was ok with that and always was for all those years until Branca quit in 2006 and even then MJ was free and able and should have changed his will then but he didn't.
Mrs J has Londell (is he still her lawyer he's not listed on the probate case documents at all) and his team hopefully working on this if they have real good ground work done then it should be an interesting case. Bringing in Rowe, Randy and Joe as witnesses will not do her case favors i hope they really do this right so Mrs Jackson is represented properly and a good case is put forward.

I also take it to mean that they can challenge whether MJ was under undue influence when he allegedly handed Branca the keys to his car 8 days before he died. If so, some fans ani't gonna be happy with what might come out and it may be tied to the criminal investigation to boot.
