I also take it to mean that they can challenge whether MJ was under undue influence when he allegedly handed Branca the keys to his car 8 days before he died. If so, some fans ani't gonna be happy with what might come out and it may be tied to the criminal investigation to boot.

the thing about the highlighted part is several people: the chef, Lou Ferrigno, the Vegas nurse, people unconnected to AEG say MJ was fine and dandy dancing exercising etc so was not "under undue influence" we have lots and lots and lots of paparazzi pics taken every week or every other week of MJ up and about in LA those pics started in April after his announcement of the tour so clearly he wasn't "under undue influence" since he was out and about happy go lucky clearly an indication of someone who has his free will. MJ had the AEG (from the major main owners to Randy Philips) meetings ALL by himself with Thome Thome in LA.... Branca wasn't part of that at all and during that time there were lots and lots of reports of MJ being up and about in Las Vegas and LA and recording with several different artists from Akon to Will.I.Am etc etc... during that time he was with Peter Lopez and previous to that with Raymone everyone during that period said MJ was in perfect condition and infact Londell McMillan was in the picture and clearly he didn't think MJ was under any influence?

MJ was recording the rehearsals, he may have had all the negotiations recorded too who knows.... it will be real difficult for Mrs J's team to concretely prove MJ was under undue influence they can't use the "i have a feeling" "i suspect" "it was rumored" "someone mentioned" kind of evidence/excuse. They would have to show real proof of that actual evidence of MJ strung out unable to comprehend anything etc... They can't use the "MJ was on drugs" excuse either since everyone claims to have had no clue that MJ was doing that and it seems he was only using Murray for a sleeping disorder issue and hence the drugs found in his body at time of death had all been injected by Murray and caused his death and they can't surely use that to say MJ "undue influence" since he got his "sleep issues" done at night and during the day conducted his business just fine.... in fact he was with the family at his parents 60th marriage anniversary and none of them thought he was on drugs then... in fact Joe and Rowe and Mrs J also met with MJ after that for a "business meeting" at the Beverly Hills and even then none thought MJ was under drugs so it will be hard to carry that....

Its a very fine line saying "we think MJ may have thought X and not Y" without concrete supported documents or proof. So my real hope is that Mrs J's lawyers have all this information and that it will come out in the clear. They also can't claim "conflict of interest" for Branca re: Sony because ALL the while MJ worked with Branca more than 20 yrs, Branca worked with him on consultancy basis not on exclusive basis and thus was allowed to have other clients and MJ was ok with that and always was for all those years until Branca quit in 2006 and even then MJ was free and able and should have changed his will then but he didn't.

Mrs J has Londell (is he still her lawyer he's not listed on the probate case documents at all) and his team hopefully working on this if they have real good ground work done then it should be an interesting case. Bringing in Rowe, Randy and Joe as witnesses will not do her case favors i hope they really do this right so Mrs Jackson is represented properly and a good case is put forward.
 
We fans must look after Michael's children, :yes: because I'm afraid
that just as Michael Jackson's family did not, in many ways, look out for him; maybe,
they may not be able to put Michael's children before their quest for more money.

 
anyone thinks that the executors can be successfully challenged and the judge put Randy or anyone else ?
Lodise, the attorney for the kids, have a say on these matters ?

I think the challenge will be on ground that mj was under " undue influence" not the executors . she is saying mj was not fit at the time .
 
Katherine Jackson is 79 years old, and I just wish for her to
be left at peace to care for Michael Jackson's children.
If the other Jacksons push things too far, Katherine's health could suffer. Consequently, the Jacksons better remember the only other adult name on Michael Jackson's will is Diana Ross.

LEGRANDE an attorney hired by Koitzner during the Bashir saga to investigate everyone in mj's inner circle ( ofcourse with the exception of koitzner , wiesner and schaffel) testified that he was brought in by koitzner because he wanted to clean house . he wanted everyone out "including Branca" so he can take control of mj's financial empire . Legrande was asked whether Branca was employed by sony and mj he said NO . Branca was not an employee for either , both mj and sony were clients of his company . he had a company dealing with legal consultancy regarding show biz ..etc . he said he felt there was a conflict of interest , he also testified that Branca had an off-shore account where sony was deposing money into . he could not verify whether it had anything to do with mj . he said he was fired by koitzner because he discovered that kiotzner and weisner stole 960.000$ of mj . he said Branca was a wonderful and very respected attorney and he could not say at all he was conspiring against mj .
 
for me if Branca works for sony as some fans think, he will fake the fight against Katherine cause he knows if the jacksons has the control of estate, the sony/atv share will be sold quickly and Branca could leave this mess with clean hand

God that has always been my biggest concern . if Branca does not object to appointing Randy as a third executor then we all know the sony/atv share will be sold sooner than later.

if she proves branca was putting a gun to mj's head or mj was complettely unfit mentally then yes the executors can be successfully challeneged , as for Randy I highly doubt he will be allowed near the estate
 
I don't have a good memory with these things, but wasn't there a lawsuit that involved Randy? I think it was around 2005 something that had to do with Randy messing up MJ's finances?
 
randy signed a deal on behalf of mj to refinance his debt , ithink the interest rate was HUGE and mj ended in much more debt than before , he also hired accountants and lawyers who failed to pay neverland employees and failed to pay mj's expenses . many of the lawsuits between 2005 and 2009 were caused by randy
 
mj never use this loan but as randy signed some deal mj was sued 2 times for 48M$ each and the estimation of settlement was 5M$ each
 
We'll see how this pans out. I imagine that for the most part she will let the administrators do their job, and only if absolutely necessary will she intervene. At least she now has has the option.

As for suggestions that Joe and Jermaine are pulling the strings behind her, I just dont see Katherine being the pushover that some of you seem to think. Because she's sensitive and loving doesnt mean she is weak.

hhmm, how could they prove that ?

if he was unfit for the naming of executors, he was unfit also for the naming of the guardian of kids


Branca & McClain didn't object. there are good reasons !

yes but the thing is she doesn't know much about business in general and she always felt like her kids should be provided for in an equal manner even if some of them don't deserve it that's what's wrong with any of the jacksons having major control over the estate

I remember about Randy now, he tried to make michael sign some deals through which he was going to end up selling the sony catalogue - talk about bad decision making

I am afraid Diana Ross won't get Michael's three children either because what LaToya was says that her mother and Diana had a talk on the phone she didn't say wants get in detail. I wish Michael should have left his children to his baby sister Janet.

yeah she will make sure Branca feel the heat when she sends witness after witness to say in a court of law how mj was unfit mentally when he made the will. i'm sure no one will be as happey as murray and his attorney , probably they are going to watch closely what katie's witness are going to say and believe me they are going to say HORRIBLE things about mj like they have been saying before and after his death .

michael wrote the will in 2002, so are karherine's lawyer trying to saying he was mentally unfit from that time to his death?

if they are trying to imply michael was incapable since 2002 , then why didnt his family do anything since then......

on one hand her lawyers are saying that she was the closest to him and that he listen to her and consults her on every matter, even his business deal.
on the other hand they are imply that this was a man that was unstable or under-duress since 2002 when he wrote the will they are trying to chanllege , yet she means to say with all the influence her lawyers are claiming she had in michael's personal and business life; so why then didnt she do something then????????

Michael had many years to change the 2002 will if he didnt like it, so him leaving it alone says he was happy with the way it was.
he might not have worked with Branca in years till recent times, but it seems michael trust him enough when it comes to his business deal and how his children would be well taken off.

put the estate in the hand of the jackson family who dont know how to control money, would probably mean they would run the estate to the ground and nothing would be left for those children when they come of age.
 
well, as aveeno said the will was wrote in 1997 and very little changes were made in 2002 to include Blankito , so katie have to prove mj was unstable or under"undue influnce " for 12 years . I can't imagine what kind of "undue influnce" he was under , I can only predict they are going to say he was mentally unstable , good luck .or was completely drugged up since 1997 , their frineds have been saying that since his death along with the siblings .

they are going to say he was mentally fucked up to get his money .
