Walgren: The People [Prosecution] have not received Discovery, statements, or reports… but only a witness list. The Defense has had enough time to time to prepare these. A large number of witnesses do not appear on our Discovery.

Chernoff: We have put down notes/memos, but we have not converted them into written form. We have documents of our findings, but it is not Discovery. If you order us to take witness statements then we will. We don’t have them now. We have had conversations, but not in writing,
Judge: So you are producing witnesses without statements? Penal code 1054.3 A states that the Defense is required to provide to the Prosecution the names, addresses of witnesses who you are calling, written, recorded reports of experts, a physical and mental examination of the defendant, real evidence at the trial. So you have nothing called for in this Penal Code Section?
Chernoff: We are aware, but no expert reports or statements are present. Once we have them then we will turn them over to the Prosecution. Thursday we have meetings… when we have them we will turn them over.
Walgren: 1054 is designed to avoid this. This is gamesmanship. We have provided immediately what we had. This is unfair to the People [Prosecution] to be produced with the Defense Discovery so near to the trial. We need time to fairly process [Discovery] so we can have a fair trial.
Chernoff: We understand. (repeated the same from before, blah blah)
Judge: Your responsibility stands beyond meetings. You were provided reports, were notes taken?
Chernoff: Memos were prepared by myself. Flanagan spoke to ?? I don’t know if notes were taken by him. My guess is we will have it by the end of the week. We are not hiding anything. Walgren says no surprises, yet he has already spoken to one of the experts we are speaking with, yet he says he is in the dark. We have 91 witnesses from the Prosecution I have gone through and I don’t have most of their witness statements.
Judge: Law requires 28 days before proceeding are due to commence. I have 107 witness names mentioned. They may not all be called… going to wait for the Discovery. ?

THIS is what the defense wanted...they dont want the prosecution to be able to have a well prepared case....they wanted them to have a half ass one..so it would look like they were not prepared and then the defense would have an easier time defending Murray....thats why they went for the 60 day trial option. They are hoping that the pros will not have time to get all of their witnesses together.

The DA is saying that the defense haven't given them copies of discovery and witness statements and the defense is saying that they don't have them yet.

btw - they could have them but try to wait till the last legally possible day to hand them over. or they are totally clueless.

Right. Could be a combination of psychological warfare, and creating chaos for the prosecution. But if they really have taken depositions, then they've lied to the judge. (Whaaaat? An attorney could LIE? :bugeyed)

He's up to something. No doubt in my mind. Psychological warfare, stalling for time, maneuvering for position, trying to create grounds for an appeal...call it what you will, he's not stupid, he's savvy.
Or could it be that HWSNBN (he who shall not be named) is running out of money?

yeah realistically they are prob just stalling. but if they keep doing this then the pros will have grounds to ask for a delay. the 30 day marker will be important

well if that the case then it looks lie Murray picked the right lawyer for himself....Murray lies too....between the two of them...don't expect any truths...:doh:

LOS ANGELES (AP) - A judge overseeing the upcoming Michael Jackson trial has questioned defense attorneys about why they are not preparing reports and statements on possible witnesses.

Defense attorneys for Dr. Conrad Murray, who has pleaded not guilty to involuntary manslaughter in the death of Jackson, said at a hearing Thursday they don't plan to prepare any such reports before the trial scheduled to start in late March.

Prosecutors called the move a clear attempt to thwart rules intended to prevent surprises from occurring during trial.

Superior Court Judge Michael Pastor called the strategy "a recipe for disaster."

A prosecutor asked Pastor to vacate the trial date, but the judge refused.

He ordered attorneys to return on Monday, when potential evidence will be discussed again.

What's "vacate the trial date" means? Postpone the trial date?

yep you got it.

defense isn't giving any of their witness statements to the DA.

the judge isn't happy with it and calls it a disaster.

DA asks the judge to delay the trial due to not receiving witness statements.

In short we call this one hot mess.

I think the defense is playing games. I don't think they don't know what they are doing. If they are required to do soemthing then do it.

btw let's stay calm as the following is unverified and comes from a highly emotional / involved / biased fan source.

Defense wants photos of autopsy WITHOUT watermarks. pros concerned it may LEAK!

the news says that there's another hearing on Monday. with the limited information we have I'll guess that the judge is taking the issue into consideration and will make a decision then.

thats not even legal is it? theres the 30 day rule for starters. i dont get how the defence can say they don't plan to prepare any such reports before the trial scheduled to start in late March. then doesnt that mean they have no witnesses. cause all witness statements etc have to be handed over.

id guess cause of the 30 day ruling. if its not handed over by then there maybe a delay. but the defence are saying they arent gonna use any at all.

whats the diff? yeah i know what watermarks are but its not relelvent. it doesnt hide anything in the pics any evidence

I too think that it's against the rules and they are required to give them to the DA. We'll see what happens I guess.

As for the autopsy pictures - they could become public if they are shown during the trial as evidence. However I can't see their relevance in this case as Michael didn't have any visible trauma.

Conrad Murray Hearing update: Next meeting is Monday, February 28th at 9:15 a.m. Walgren will be in attendance; he was out today.

Conrad Murray Hearing update: Mj Estate Lawyer, H. Weitzman arrived at court with M. Geragos & Narej Gourjan , they were in high spirit.

Conrad Murray Hearing Update: Mark Geragos stated there would be no problems or conflict with Gourjan's representing Conrad Murray.

Conrad Murray Hearing Update: Judge Pastor had some concerns re: Gourjan repping Murray. Pastor will sit on it until next week.

Conrad Murray Hearing Update: Defense had no discovery, only the name of 1 witness (no phone #) who had heart attack & Murray saved him.

Conrad Murray Hearing Update: Judge Pastor declared today a complete waste of time. The trial date may be pushed back.

Conrad Murray Hearing Update: Pastor said there are too many important decisions being made in the case for Murray not to be at hearings.

Conrad Murray Hearing Update: Judge Pastor want Conrad Murray to start attending the scheduled hearings.
