LOS ANGELES — A former security worker for Michael Jackson told a jury Thursday that he was concerned the singer would overdose on prescription medications in the early 2000s but didn't see signs of impairment in the singer later that decade.

Michael La Perruque said he occasionally went into the singer's hotel room to make sure he was breathing and would often find doctors to treat the pop superstar when he traveled. La Perruque retired from his job as a sheriff's deputy in 2001 to work as the head of Jackson's security detail and frequently traveled with him until 2004.

La Perruque said the singer's children called 911 during a trip to Florida in 2001 or 2002 after their father collapsed in a hallway in a hotel suite at Walt Disney World. He said he found Jackson unconscious, revived him before paramedics arrived and never saw any signs of drugs or alcohol that the singer may have taken.

Paramedics checked out the singer and determined he didn't need further medical attention, La Perruque said.

Deborah Chang, an attorney for Jackson's mother said there was no evidence that the incident was drug-related.

He told jurors that his testimony Thursday was only the second time he had told the story. The first came in a deposition with lawyers for AEG Live LLC, which is being sued by Jackson's mother claiming the company negligently hired the doctor convicted of giving her son a fatal overdose of the anesthetic propofol.

AEG denies it is responsible for the singer's death.

La Perruque stopped working for Jackson in 2004, but returned to oversee his security in late 2007. He said he didn't see any signs that Jackson was impaired during the few months he worked for him again.

He testified he last saw Jackson two weeks before the singer's death and he looked fine, but he noticed that his former boss was skinnier than usual.

La Perruque said he spoke to two of Jackson's doctors about his concerns about the singer's prescription drug use, but that he never spoke directly about it to the singer because he didn't want him to become defensive.

"It was my concern that he may overdose," he said.

He said he knew Jackson had severe back pain and difficulty sleeping. Despite seeing the entertainer impaired, La Perruque said he never saw Jackson take any drugs or saw any signs of medications lying around.

Jackson did try to get help, he said. "He fought very hard to be sober," La Perruque said. "He fought very hard not to be dependent on these prescription medications."

Jackson however kept members of his family away because he knew they were trying to stage an intervention, he said.

He told jurors that Jackson's younger brother Randy arrived at Neverland Ranch one day in a helicopter to speak with his brother about his medication usage. La Perruque said he turned him away.

He said Jackson called him in the middle of the night between 20 and 30 times in the early 2000s and was often mumbling and incoherent. Half those times La Perruque said he went to the singer's room to check on him, and they would start talking.

"I think he was just lonely," La Perruque said. "He wanted somebody to talk to."

Los Angeles (CNN) -- Michael Jackson's estate never gave an expert it hired permission to help AEG Live defend against the wrongful death lawsuit filed by Jackson's mother and children, the estate's top lawyer said Thursday.
The revelation raised questioned about the testimony of entertainment industry consultant Eric Briggs, who was hired by AEG Live to challenge the Jacksons' expert opinions concerning damages the concert promoter might owe if found liable in the singer's death.

Briggs told the court this week that his company -- FTI Consultants -- had gotten a waiver from a Jackson estate lawyer before agreeing to work on the concert promoter's defense.

Briggs had signed a confidentiality agreement with the Jackson estate in 2010 when he was hired to determine the value of its biggest asset -- the Sony-ATV music catalog that includes the Beatles songs -- for the estate's tax filings in 2010.

He was hired by AEG Live lawyers in February to prepare a challenge of the opinion of an expert hired by the Jackson lawyers to calculate how much money the singer would have earned had he not died while working on his comeback concerts in 2009.

Briggs said he -- or someone else in his company -- gained permission from the Jackson estate lawyer Jeryll Cohen to waive any potential conflict of interest.

"No one from the estate or any lawyers authorized or waived any potential conflict for FTI or Mr. Briggs," Jackson estate attorney Howard Weitzman wrote in an e-mail read in court Thursday.

Such a waiver would be counter to the interests of the estate's beneficiaries -- Jackson's mother and three children, a Jackson lawyer said.

Despite the conflict, the judge ordered Briggs to answer questions posed by Katherine Jackson's lawyers about the music catalog. He said although his valuation placed Jackson's interest in the catalog at about the same level as Jackson's debt at the time of his death -- which he said was $400 million -- the IRS challenged it as low.

An independent analyst hired by the IRS concluded he had undervalued Jackson's interest in the catalog by up to $300 million, Briggs testified.

Jackson lawyers argue it is evidence the singer was not broke when he died, contrary to what Briggs said in his testimony.

Briggs testified this week that it was his opinion that it was speculative that Jackson would have earned a dime more in his life if he had not died of a propofol overdose on June 25, 2009. He based his opinion the testimony of a doctor who said earlier that he did not think Jackson would have lived even another week past that date.

Panish, however, pointed out that the doctor's opinion was based on the assumption that Dr. Conrad Murray would still be giving Jackson nightly infusions of propofol -- the surgical anesthetic the coroner said killed him -- as a treatment for insomnia. The Jackson's suit contends AEG Live is liable because it negligently hired, retained or supervised Murray.

LOS ANGELES (KABC) -- Jurors heard from Michael Jackson's former security chief during the Jackson family's wrongful death trial on Thursday. They learned about a medical emergency involving the pop star that few people had known about.

About six years before Jackson stopped breathing in his Holmby Hills home, he fell unconscious at an Orlando hotel, according to his security director, Michael La Perruque.

La Perruque, a former Los Angeles sheriff's deputy, testified about an incident he says he has never disclosed publicly until now. He says hotel security alerted him that Jackson's children had called paramedics.

La Perruque said, "I found the two children crying. Prince and Paris, they were crying. They were saying they couldn't wake up daddy."

He told the jury that Jackson had collapsed on the floor but was still breathing. La Perruque said he helped Jackson get to bed, where he came to. AEG defense attorney Marvin Putnam asked if he later discussed the incident with Jackson.

La Perruque said no and that he didn't think it was his place to discuss it.

La Perruque worked for Jackson between 2001 and 2004, a time in which Jackson sought help from Dr. Alimorad Farshchian for addiction to Demerol and received an implant to inhibit the drug's effects.

La Perruque testified that he had concerns that Jackson may overdose and that 10 to 15 times he had observed Jackson slurring his speech, mumbling and nodding off in meetings.

Despite the episodes, La Perruque says he never saw meds in Jackson's hotel room or saw him take medications.

La Perruque described a failed intervention at Neverland Ranch in 2001. He said Jackson's brother Randy hired a helicopter to breach the perimeter and land on the grounds. He said that Jackson asked to have Randy sent away. La Perruque said he complied.

The AEG defense contends that the company should not be held liable for Jackson's death because AEG didn't know about medical conditions that Jackson kept secret and that Jackson insulated himself, even from his family.

The plaintiffs elicited testimony that the times Jackson was slurring his speech could have been from a sleeping pill because the star struggled with insomnia. La Perruque stated that there was no indication that the singer was taking any drugs in front of his children and that if he thought the children were endangered, he would have called authorities.

La Perruque will continue his testimony on Monday when the trial resumes.
 
Michael Jackson's survivors vs. AEG: a gold mine for witnesses


Wrongful-death suit means lots of expert medical and business testimony. And that means each side pays big bucks to those who take the stand.

A lot of people are making a lot of money off the Michael Jackson wrongful-death case — and then there are the lawyers.


Witnesses in the case are being paid huge sums to analyze the pop star's earning power, his health, his popularity, even his inability to get a good night's sleep.


Attorneys representing concert promoter AEG Live on the one side and Jackson's mother and his three children on the other have so far spent around $1 million just on experts who have testified about how much money the singer could have earned had he not died in 2009 from an overdose of the anesthetic propofol.


That doesn't include physicians who are also being paid as expert witnesses. One of them, Dr. Charles Czeisler, a Harvard University sleep expert, testified how propofol may have affected Jackson. He was paid $950 an hour.


"For $950 an hour, can you please keep your answers short?" said attorney Michael Koskoff, drawing laughter from jurors.


The stakes in the lawsuit, in its third month and counting, are enormous — at least in terms of dollars. Each side is bringing in highly paid experts to convince jurors of their case, sometimes leading to dueling witnesses.


Certified public accountant Arthur Erk, testifying for the Jacksons, calculated that the singer could have made $1.5 billion if his doomed "This Is It" concert series in London had blossomed into a world tour, and an additional $500 million from subsequent tours, endorsements and merchandise sales.


Erk told jurors that he was being paid $475 an hour and that his firm had so far billed $332,500. The clock was ticking as he sat on the witness stand, telling the jury how much he was making.


AEG's expert was Eric Briggs, a senior managing director at FTI Consulting in Century City. He said it was speculative to think Jackson would earn anything at all because of his drug use, erratic behavior and track record of canceling shows. The notion that he could even pull off such an ambitious tour was doubtful, he said.


Briggs testified that he was costing AEG $800 an hour and that he had already spent about 350 hours on the case. He said his team put in 500 to 600 hours and that they had billed AEG between $600,000 and $700,000.


From the beating he took on the stand from Jackson attorney Brian Panish, he might not have thought that was enough.


One of the consultants who worked with him, Briggs testified, was a year out of college. Briggs said he had done "general research," such as finding out the capacities of arenas where Erk said Jackson might perform during his world tour.


The recently graduated consultant charged $350 an hour.


So whom are the 12 jurors to believe?


USC law professor Jody Armour said people tend to think of experts as neutral observers reciting facts.


"But these experts are actually trying to persuade the jury that their version is the version they should buy," he said. "It's an odd role these scientific experts are thrown into."


The Jacksons have sued AEG Live and two of its executives, alleging that the entertainment company negligently hired and controlled Dr. Conrad Murray, who administered the fatal dose of propofol to Jackson. AEG says the singer hired Murray and that any money the company was supposed to pay the doctor was part of an advance to Jackson.


When the dollar stakes are far lower, plaintiffs' attorneys, who usually foot the bill for experts, must think twice before taking a case. The amount they can collect — even if they win — might make it not worth their time, lawyers said.


Expert testimony can backfire. The Jacksons' attorneys liked the deposition of AEG expert Dr. Paul Early so much that they played portions of it during the trial. Early testified that addicts shouldn't be blamed for their problem.


AEG has not called him to the witness stand.


The fees that witnesses charge can vary greatly. Gordon Matheson, head of Stanford University's sports medicine program, testified as an expert for the first time. His fee was $500 an hour. Matheson testified that Murray had conflicts of interest that would probably lead to poor medical decisions.


Dr. Daniel Wohlgelernter, a cardiologist who testified for the Jacksons, said he receives about 20% of his income as an expert witness. He said he had testified in 31 trials and been retained as an expert in 400 cases. He was paid $4,250 for half a day of testimony and $450 an hour to prepare.


Czeisler, the Harvard sleep expert, testified for the Jacksons for several days. AEG's attorneys argued that though he may be a world-renowned sleep expert, he wasn't an expert on propofol.


That forced the Jacksons' attorneys to call anesthesiologist Emery Brown, who holds endowed chairs at Harvard and MIT and is considered one of the world's experts on the anesthetic.


Brown, who testified in a video deposition, said he was being paid $1,000 an hour but that he was donating his $75,000 fee to Massachusetts General Hospital.


Jurors, Armour said, often suspect that one side or the other is buying an expert to provide the testimony it wants. Brown's contribution, Armour said, boosts his credibility to the jury.


"He's donating it all to charity, ladies and gentlemen of the jury, so this is coming from the heart," Armour said. "It's a bowl-you-over rhetorical move to make."

Los Angeles (CNN) -- Michael Jackson's former security chief testified that he worried at times that the singer might overdose on drugs, but he didn't think he was an addict.
Michael LePerruque, who traveled with the pop icon for three years a decade ago, returns to the stand Monday for more testimony in the wrongful death trial of Jackson's last concert promoter.
AEG Live called LePerruque as a witness in an effort to show jurors that Jackson was a secretive drug addict, making it impossible for its executives to know his life was in danger as he prepared for his comeback tour.
Michael Jackson's mother and three children are suing the promoter, contending the company is liable in his death because it negligently hired, retained or supervised Dr. Conrad Murray, the physician convicted of involuntary manslaughter in Jackson's death.
LePerruque, however, spoke glowingly of Jackson and after his first day of testimony last week he sought out Katherine Jackson to give his former boss's mother a hug.

He was hired as the chief of Jackson's travel security team after he retired from the Los Angeles County Sheriff's Department, where he served as a deputy for 22 years. Part of his training involved recognition of when someone was under the influence of drugs, he said.

He would go to Jackson's room many of those nights to check to make sure he was alright, he said. He appeared to be intoxicated, he said. "I think he was just lonely and wanted to have somebody to talk to."
Under cross examination by Jackson lawyer Deborah Chang, LePerruque said Jackson's intoxication appeared to be consistent with someone drinking alcohol and taking sedatives to sleep.
Did he think he was addicted to drugs? "I wouldn't be able to say that he was addicted to those," he answered.
The security chief said he would sometimes notice empty wine bottles from the hotel room's minibar, but he never saw drugs. He also never witnessed Jackson take medications, he said.
He described a scary incident in 2001 when Jackson's children dialed 911 for help when they found their father passed out in the hallway of their suite at a Disney World hotel in Orlando, Florida.
Paris and Prince, then just 3 and 4 years old, were "crying, saying they couldn't wake up daddy," he testified. Jackson woke up after LePerruque performed mouth-to-mouth resuscitation and shook him, he said. Paramedics found no signs of a drug overdose, he said.
"It was my concern that, yes, he may overdose," LePerruque said.
LePerruque said he never confronted Jackson about his drug use because he "didn't want to put him on the defensive." To do so might have created a barrier, he said. "I wanted to be able to be close to him to monitor him to protect him."
The incidents of slurred speech and incoherent late night phone calls did not happen over the entire time LePerruque worked with Jackson, he said.

He told of one conversation in which Jackson told him he was not going to use drugs again.
"Do I seem clear?" he said Jackson asked him. "I just want you to know that I'm going to stay this way, that I'm not going back to the way I was."
Their late night talks revealed to the guard that Jackson had trouble getting to sleep, a problem that would eventually lead to his death. He told him he couldn't sleep because his brain wouldn't stop creating music.
"He said that as an artist he always had a tune in his head, different melodies, and he wasn't able to stop it," La Perruque said. "It was always constant going through his brain.
The coroner ruled that Jackson died of an overdose of propofol, which Murray told investigators he was using to treat the singer's insomnia.
The incidents in which Jackson appeared to be under the influence of alcohol and drugs became more frequent after the broadcast of a documentary based on Martin Bashir's extensive interviews with him. LaPerruque said Jackson was "very devastated" by what he thought was the betrayal of trust he had with Bashir. Child molestation charges were filed in Santa Barbara County, California, after the broadcast.
LaPerruque said he never believed the criminal charges against Jackson were true. If he suspected he was molesting children he would be the first to slap handcuffs on him, he said.
"I came out in full support of him," LaPerruque said.
Jackson was acquitted on all charges after a trial.
LaParruque called Jackson "very down to earth," saying he was proud to have worked for him.
"There were times there were difficulties, but for the most part it was a pleasure working for him," he said.
He noted that one problem Jackson had was keeping up with his cell phones. He lost 27 of them, he said.
The wrongful death trial begins its 15th week in a Los Angeles courtroom Monday. The judge projected the trial will last until the middle of September.

LOS ANGELES (AP) — An attorney who drafted the agreement for Michael Jackson's doctor to work on his ill-fated comeback concerts testified Tuesday that she told a tour promotion executive that the physician appeared to be successful just days before the entertainer's death.

Kathy Jorrie, an independent attorney who has handled nearly 300 matters for AEG Live LLC, said she told the company's CEO that the physician was properly licensed during a conversation six days before Jackson died in June 2009. Jorrie said she also told the executive that former cardiologist Conrad Murray told her his medical clinics were earning more than $1 million a month.

Jorrie's comments to AEG Live CEO Randy Phillips came the same day that Jackson showed up to rehearsals shivering and unable to practice, according to testimony in a negligent hiring case filed by Jackson's mother. Within hours of speaking with Jorrie, Phillips was fielding emails from tour workers describing Jackson's condition as deteriorating and expressing concerns about the singer's health.

In one of Phillips' emails to tour director Kenny Ortega the following day, the executive called Murray "extremely successful" and wrote that AEG Live had checked him out.

Jackson's mother is suing AEG Live, claiming the company did not properly investigate Murray. AEG denies any wrongdoing.

No background check was conducted on the former cardiologist, who was convicted of involuntary manslaughter in 2011 for administering a fatal dose of the anesthetic propofol to Jackson on June 25, 2009.

Jorrie testified Tuesday that she reviewed records that showed Murray's Nevada clinic had a valid license, the physician was licensed to practice medicine in four states and she searched his name on Google.

The attorney told jurors that she spoke to Murray about an agreement she drafted that would have paid him $150,000 a month to accompany Jackson to London for 50 concerts. She said she questioned the doctor about a request in the contract for CPR machines, but she was satisfied with his response that the singer's shows were strenuous and he needed lifesaving equipment nearby if there was an emergency.

Jorrie also told jurors she mistakenly left language in a contract that Murray signed that called for him to perform services "reasonably requested" by AEG Live.

She maintained throughout her testimony that Murray was Jackson's personal doctor and the language about him performing services for the promoter shouldn't have been in the agreement. Jackson's approval was required on the contract, but he died before signing it.

Katherine Jackson's attorneys claim AEG created a conflict of interest for Murray, who was deeply in debt before Jackson's death.

AEG Live's lawyers have told jurors that Jackson made the decision to hire Murray and requested the propofol treatments to help him sleep.

LOS ANGELES (KABC) -- The Michael Jackson wrongful death trial on Tuesday focused on the agreement with the pop star's doctor, Conrad Murray. That contract could be a key element in the case.

If Jackson's death was caused by his doctor, then whoever hired the doctor for the star's comeback tour should be liable for his death, according to Katherine Jackson's lawsuit.

Now under scrutiny before the jury is Murray's independent contractor agreement, which was drawn up by AEG Live but never signed. The AEG defense says the document holds evidence that Jackson requested Murray to be his personal physician and dictated his salary.

Attorney Kathy Jorrie, who wrote the agreement, walked the jury through the many changes made to the document. Her appearance set off objections from the Jackson attorneys.

"She never spoke to Michael Jackson, she doesn't know. But we know that, at least based on the evidence, AEG did hire Dr. Murray. And the contract she negotiated was never sent to any representatives of Michael Jackson," said Jackson attorney Brian Panish.

The defense says Jorrie spoke directly to Murray about the terms the doctor and Jackson wanted.

"Michael Jackson wanted to bring his long-time physician with him. That it was at his solo and absolute direction, that this would only occur with his, um, normally saying he wanted it done, but he actually had to sign and say so, and had to sign and say that he would be the one paying for it," said AEG lawyer Marvin Putnam.

Jorrie says that she questioned Murray's salary of $150,000 a month. Murray's response, she testified, was that his practices in four states brought him $1 million a month.

Jorrie says she did an Internet search and found Murray's practices listed. She said the medical boards in the four states showed no record of disciplinary action against him.

Jurors learned through earlier testimony that Murray was broke. About Murray's contract not being signed, the Jackson attorneys say it doesn't matter.

"You don't really need a contract to hire someone. As we've seen in this case, many people have worked for AEG that didn't have a contract," said Panish.

But AEG's interpretation of the law is that the unsigned agreement nullifies everything.

"As long as you have that agreement that you're not going to have an agreement unless signed by the parties, then you can't override that," said Putnam.

Jorrie is back on the stand Wednesday to face cross examination by the Jackson attorneys.

The attorney hired by AEG to draft Conrad Murray’s contract for Michael Jackson’s ill-fated “This Is It” tour testified Thursday that the the doctor had requested a CPR machine and a back-up physician.

Kathy Jorrie, an outside attorney who has long worked for AEG, said when she began the negotiations in June 2009, tour accountant Timm Woolley told her Murray was the singer’s personal physician and would provide general medical services during the 50-show London tour.

During questioning by AEG attorney Jessica Stebbins-Bina, Jorrie said she spoke to Murray twice on the phone during the negotiation process, which produced three drafts of the contract the doctor ultimately signed.

The central question in the wrongful death case filed by Jackson's mother and three children is who hired Murray. Katherine Jackson and her grandchildren allege AEG negligently hired and controlled the doctor, who gave the singer a fatal dose of propofol two weeks before his comeback tour was set to open.

AEG alleges it was Jackson who hired Murray, and any money that was supposed to be paid to the doctor was actually part of an advance to the singer.

Murray is now serving jail time after being convicted of involuntary manslaughter in Jackson's death.

Jorrie said she first spoke to Murray on the phone on June 18, after he reviewed an initial draft of the contract. He asked that his company's name be added to the contract and that a provision allowing him to hire a nurse as an assistant be changed to a "qualified assistant medical person."

"I had asked him, 'Why would you need another physician as opposed to a nurse?'" Jorrie testified. "And he told me that in an event that he was not available or he was tired, he wanted the flexibility" to have a back-up.

Murray asked that he be responsible for hiring the additional doctor, but did not provide a name, Jorrie said. The attorney testified that she ultimately agreed to the change.

Murray also requested that should his contract be terminated early, he would not be required to refund his $150,000-per-month payment. Jorrie said Murray told her that his medical practices brought in "a million dollars a month" and because he was leaving those practices for the tour, "it'd be fair and appropriate" that he keep the full payment he had received.

Jorrie said she also spoke to Murray about his request for medical equipment. Woolley had provided her a list of items the doctor might ask for, she testified, and she wanted to know why a "CPR machine" was on the list.

"He said he needed it in London during the performance, Michael Jackson puts on a strenuous performance and that he did not want to take a chance," she said. "That should anything go wrong, should there be an emergency, etc., he wanted to have that."

When she asked if having a machine available at the O2 Arena would suffice, she said Murray said no.

"He said they would" have the machine, she said, "but that he didn't want to take a chance."

After speaking to the doctor, Jorrie said she searched online to confirm some of his background. She verified his company was based in Nevada and that he had medical licenses in four states.

She also "Googled him," she said. "I Google everybody."

Jorrie said she attempted to email the revised contract to Murray, but the email bounced back. She then sent it to Woolley, who forwarded it to the doctor.

Murray called June 23 with additional changes that involved when his payments would begin and extending the time of his services from September 2009 to March 2010. Murray told her Jackson had agreed to pay his monthly salary for that extended time frame, she said.

Jorrie said she sent Murray another draft based on the changes. The next day, she testified, she received a copy of the agreement via fax that had been signed by Murray.

The attorney testified that she never directly communicated with Jackson or sent the singer or his representatives any versions of the contract, though there was a space set aside for the pop star's signature. The empty line on the contract shown to jurors Tuesday was dated June 24, which is when Jorie said she expected the parties involved to sign the final agreement.

Jackson died the next day.

An attorney for AEG Live testified Wednesday at the Michael Jackson wrongful-death lawsuit trial that all three drafts of Dr. Conrad Murray’s contracts were sent to the concert promoter’s general counsel, but none to the pop star’s representatives.

A key element in the case is who Murray was working for.

Jackson's mother and three children are suing AEG Live, saying the company negligently hired and controlled Murray, who gave Jackson a fatal overdose of the anesthetic propofol as he was preparing for a comeback tour in 2009. AEG says it was Jackson who hired the doctor.

Kathy Jorrie also testified that while changes were made in the drafts of Murray’s contract, every version said Murray was to “Perform the services reasonably requested by Producer,” AEG.

Murray signed the final draft on June 24, 2009, the day before Jackson died. Neither Jackson nor an AEG representative had signed it.

Jorrie testified she told AEG Live Chief Executive Randy Phillips that Murray was successful, based on a 10-minute Google search and a conversation in which the doctor told her his four clinics were grossing $1 million a month. She testified that her Internet research turned up one clinic in Nevada and another in Texas.

She didn’t discover that Murray was actually deeply in debt. Under questioning by Brian Panish, the Jackson family attorney, she said she hadn’t checked to see if his house was in foreclosure or if he owed child support.

“I could have,” Jorrie said.

Jorrie’s characterization of Murray would come back to haunt Phillips, who wrote an email a few days before Jackson died saying he was “gaining immense respect” for him. “This doctor is extremely successful (we check everyone out)… “

Murray was eventually convicted of involuntary manslaughter and is serving a jail sentence.

The trial also turned to AEG’s relationship with Tohme Tohme, the singer's sometime manager, a man who was referred to as a “doctor” even though no one seemed to know whether he really was a physician or held a Phd.

Jurors were shown letters and emails Jackson wrote saying Tohme was not his representative, although concert promoter and producer AEG Live acted as if he were.

Jorrie expressed reservations about Tohme as early as January 2009, five months before the singer died.

In an email to AEG executives, she wondered "whether or not he is the real McCoy... Nonetheless, I recommend that a background check be performed through a private investigator and/or at a minimum, that someone at AEG Live meet with Michael Jackson to make sure he understands that we are entering into a tour agreement with him that will require him to perform a worldwide tour.”

No private investigator was hired.

A copy of the email was sent to Peter Lopez, one of Jackson’s attorneys.

On April 22, 2009, Jackson wrote Phillips, “This letter shall serve to confirm that I am not using Dr. Tohme for tour production management services and that I do not intend to use Dr. Tohme in the future for tour production management services or with respect to other event related matters.

"Therefore, you are not authorized to pay Dr. Tohme or any of his affiliated companies for any such services in connection with my upcoming tour or any future tours or other events..."

Jorrie testified she did not see the letter before Jackson died on June 25, 2009.

However, on June 28, 2009, three days after Jackson died, Tohme was given a document to approve payment of the $34 million AEG had advanced the singer. Jorrie testified the document was drawn up by her and Shawn Trell, AEG Live's general counsel. The document, signed by Tohme, said he was an officer of Michael Jackson Co. LLP and had authority to act on the company's behalf.

A Jan. 14, 2009, email from Jackson attorney Dennis Hawk to Jorrie said the singer was "the sole officer" of the company "and will be the signatory to the contract on behalf of the entity.”

Jorrie said AEG executive Paul Gongaware, a defendant in the suit, may have told her Tohme was an officer of the Jackson's company. Included in the document were 35 pages of expenses that Jackson supposedly owed AEG.

Jorrie testified that the document was never sent to Jackson's lawyers, even though it was handed to Tohme in the office of one of them.

The man who skippered Michael Jackson's "This Is It" rehearsals blamed the pop star for the predicament that led to his death.

Kenny Ortega, the tour's director and producer, testified in the Michael Jackson wrongful death trial this morning that Michael called the shots, adding, "I don't think he was being very responsible."

Ortega -- who was called as a witness by AEG Live -- testified he was not responsible for MJ's health. Ortega told the jury that Michael was squarely in charge, and made it clear that the singer and Conrad Murray called the shots when it came to MJ's well-being.

Ortega's testimony is critical, because Ortega is linked to AEG and had day-to-day contact with Jackson. Katherine Jackson is trying to show AEG called the shots and hired Dr. Conrad Murray. Ortega is clearly taking issue with Katherine.

In fact, Ortega came close to saying when it came to medical treatment, he was Michael's bitch, having to endure scoldings by Dr. Conrad Murray when the doc felt Ortega was contradicting him.
