Michael Jackson Estate Can Proceed with Lawsuit Against Memorabilia Website




A federal judge is allowing a lawsuit brought by the Michael Jackson estate to continue against the operator of a website that sells various MJ memorabilia.

The lawsuit was filed last year against Howard Mann, who operates MichaelJacksonSecretVault.com, which sells rare artwork, photographs, sound recordings and other merchandise. Notably, Mann is a former business partner of Michael Jackson's mother, Katherine, and the lawsuit represented an aggressive attempt to police the late singer's intellectual property and likeness after his passing.

In an order denying a motion to dismiss, Judge Dean Pregerson is allowing the lawsuit over whether Mann is trying to cash in on Jackson's legacy to continue.

Mann attempted to dismiss the case based on a 2004 lawsuit that was dismissed at a preliminary stage, but the judge rules that the record in that case was "undeveloped" and the identity of the claims are subject to factual dispute.

In another legal development involving the Michael Jackson estate, it has reached a settlement with a nonprofit that claimed to be continuing the singer's Heal the World charitable work. The estate claimed this is infringing its trademarks and the pop singer's likeness rights. Terms of the settlement are confidential.

I wonder where the writer of this article got information regarding Mann being a FORMER business partner of Katherine Jackson or was that just a "slip" of the pen.

I guess if this information turns out to be true, we will ALL find out in due course.

For sure and I'm sure kick backs are involved. Katherine was never active in Michael's charity work in all the years before his death. Why now?

Because MJ say she can, can please forgave KJ and hope she will see the erro in her ways, know that the estate have KJ in hand they can monitor her association.

Mann's lack of popularity is not good for business. I wonder if the business partner is becoming

a hidden partner because of that.

If Katherine really is not working with Mann anymore and the fate of their contract is in question, then my personal guess is that she would either pay him to let her out of the contract and then she'd have to make sure the court knows about the payment or she'd just let him sue her. Either way, he'd get money unless a judge rules that he shouldn't get money, in my opinion.

Katherine Jackson's business partner is attacking reports that MJ's mom turned her back on him -- in fact, TMZ has learned, he's even enlisting the help of his lawyer to quash the rumors once and for all.

It all started with a recent article on The Hollywood Reporter -- published last week -- which referred to Howard Mann as Katherine's "former business partner" ... a title Mann takes serious umbrage with.

Mann's lawyer responded by firing off a cease and desist letter to the publication on Friday -- claiming the article is "sorely lacking in fact, journalistic integrity and simple ethics" ... and insisting Mann and Katherine "remain business partners and friends to this day."

Katherine even released her own statement in response, claiming, "Howard has been great to me and my family ... I look forward to our continued relationship and our future business projects."

Mann -- who runs Jackson's Secret Vault with Katherine -- wants THR to issue a retraction stat ... or else.

With EVERYTHING that has happened thus far, who even knows if that ONE-LINER even came from Katherine Jackson. LOL!

You really need a score-card to keep up with the madness.

I wouldn't be at all surprised if Katherine's new attorney advised her against this so-called partnership with Howard Mann. In my opinion any GOOD attorney would have a problem with that "partnership."

I don't believe she is vulnerable at all. In my opinion, she is just trying to amass as much money as possible, so that she can leave "something" for the adult children (and their children) that she has been financially helping out over the years.

I also believe when Katherine Jackson found out that she would not be inheriting 40% of Michael's estate, this PLAN B, went into effect.

Where is it stated Katherine will not recieve her 40% once estate is out of probate ?

I think Big Apple means that Katherine can not will her 40 % away to her children. When Katherine passes, her 40 % will go to Michaels kids.

KJ is NOT a heir. she does NOT inherit 40% of the Estate. She will continue to receive an allowance till she passes even after the probate is over. the 40% is just the size of the trust that will be created in her name. that trust will be the source from which her monthly allowance will be paid. so even if the Estate makes $1 billion, KJ will NOT receive 40% of that money. of course,that portion will go into her trust but she WON'T have access to that money. But when she passes her trust gets transfered to the kids's trust.

the will never said she will get 40%. She will get an monthly allowance from the 40%.not 40% in full
