Now imagine a scenario in which somehow it is proved that MJ isn't the lead vocalist. Let's say his vocals are simply pasted from other demo sessions.
Parallely to these vocals another singer covers the most part of the songs. Wouldn't that be considered either as as a duet or featuring vocals by MJ which are included in the term "previously unreleased vocals"?
Now a subquestion. What legal grounds could SONY use if the Cascio lead singer is proven to be someone else?

Generally speaking a second vocal could be anything from a duet to featuring to back vocals - depending on the agreement and amount of contribution. Regardless of the amount / situation that person has to be credited. so the question becomes in your example : who is the another singer? is he credited?
do you know the lawsuit of Yvette Marine vs. Virgin Records? Let me tell it
1991 - The era of not required music credits and Milli Vanilli, Black box, Technotronic, C&C music factory etc with "models / dancers" as lip sync while the real singers go uncredited. Paula Abdul releases her first album. Her background vocalist Yvette Marine sues Virgin Records.
Yvette says she was hired to sing guide vocals and back vocals. Virgin agrees that this is true. She was indeed hired as a session musician and paid accordingly.
Yvette says on 3 songs of her guide vocals wasn't deleted but instead used in the final songs to create a "composite" lead with Paula Albul's vocals. (Remember when I said a similar thing and TPIMaster claimed it was impossible anyway). Yvette argued that therefore she was the "co-lead" and should be credited as such and that she should receive royalties. She also said that the album lacked "truth-in-packaging and truth-in-advertising"
Virgin denied it saying that it wasn't a composite co-lead, she only was on minimal background vocal parts and she was credited for it. (Yes she was credited for the back vocals)
In the end Yvette lost and Virgin records won because the jury thought that "background vocals" was an adequate enough credit. (even though her whole guide vocal was left in one song as a double)
Interesting fact : La Reid testified that he used vocal doubling on artists including Whitney Houston, Michael Jackson and Bobby Brown and always credited such as background. link
so in short by using the above lawsuit as a precedent I think they can only get away with a credited but composite vocal.

hmm ask Gaz to be sure but I don't think so. Nothing whatsoever about the leaked tracks , that's certain. I don't know about the released tracks (BN, KYHU and Monster) but to be sure I'll say no.
