it was confirmed to be from like 2004, long ago, it is definately not 07/08, it was Janet's birthday they say, or some other family function. but it was before the trial.

According to TSCM :

On his MySpace he has captioned the picture, "M.J.'s Birthday Party In L.A." which would make it 2004 -- It was between August 29th and September 1st that they rented the place in Los Angeles to celebrate his birthday.

Edit: Officially the picture is from August 30th, 2004 at Noe Restaurant in Los Angeles... At the Omni Hotel.

Yeah this is about 06 or 07 because Janet is kinda chunky not saying she's fat but shes a little bit bigger than usual.
