PHILADELPHIA — CBS continues to fight the $550,000 fine for Janet Jackson’s infamous 2004 Super Bowl “wardrobe malfunction,” insisting the network is not responsible for the fleeting nudity.
The 3rd Circuit Court of Appeals in Philadelphia had thrown out the FCC fine as arbitrary. But the U.S. Supreme Court ordered the court to reconsider, leading to new arguments Tuesday.
CBS lawyer Robert Corn-Revere says the FCC had always applied the same decency standards to words and images — and excused fleeting uses. Janet Jackson appeared bare-breasted in the halftime show for nine-sixteenths of a second.
But FCC lawyer Jacob Lewis says the duration of the offense is not the only factor. And he argues that CBS was warned the act might include some shocking surprises.

They show more on the soaps. That small flash it happened so fast, it was barely noticeable but it is okay to have oversexed commercials on t.v , radio, and print. FCC needs to get a life.

Where I live, there's billboards for "Gentleman's Clubs" everywhere. Also there's Grand Theft Auto where you run over people and pick up prostitutes. Or what about those Anime cartoons?

They focus on the wrong things. Like Janet and Michael said about this in 2005. The name Jackson had a lot to do with it. MJ had been arrested for those awful charges so they had to get Janet; they didn't want to have the name Jackson to be positive anywhere. Breast are beautiful...I have some. The FCC probably love to look at breast. Ha Ha Ha.

(RTTNews) - A Philadelphia appeals court has been ordered to review the $550,000 fine handed down to the CBS Network by the FCC after Janet Jackson's "wardrobe malfunction" at the 2004 Superbowl.

During her performance at the game's halftime show with Justin Timberlake, a portion of Janet's costume broke, exposing her breast for roughly one half of a second.

The court initially dismissed the fine in 2008, stating that the FCC acted in an "arbitrary and capricious" manner by demanding such a steep penalty for the brief incident. However the Supreme Court has ruled that the lower court must consider reinstating it.
The news comes at busy time for Janet, as it was recently confirmed that she will be taking the place of her late brother, Michael, during a Jackson 5 reunion tour. Though no official details have been released by the family, Jermaine Jackson confirmed that Janet will join the tour while on a recent promotional tour in Australia.

"Janet will be joining us. We're all talking about it now. She has never played with us before so that will be very special. She definitely wants to do it," Jermaine told interviewers. "We had a conference call and Janet has agreed to join us on tour."

God, why when Jan seems to be moving on do they always bring this up ! it was so stupid when they blacklisted her in 2004 when it happened. If they wanted to blame someone they should have blamed justin timberlake after all he's the one who did it !! but instead they attack the victim WTF !!!
 
I guess it's the principle, but $550,000 doesn't seem like it would be much money to CBS to be fighting the FCC about it 6 or 7 years later. CBS must have spent a lot on lawyers and court costs.
 
'shocking surprises'? that doesn't mean anything. not that cbs cares about Janet, cus i'm sure they don't, but i don't think the prosecution has a case, here. and i don't think the prosecution cares about janet, either. networks warn of nudity all the time, and the prosecution, the fcc and the networks approve of it, and show it on tv screens in front of children, regularly. this is just about going after a Jackson again.

i cant believe after all these years they are still trying to make this in to a case! dont they dont have anything better to do with their time?? I dont see what the big deal is about Janet's boob showing on the superbowl half time show. if anything that was the last half time show that had anyone talking bc the last few years have sucked soo bad!

I was not offended by janet's boob at all. I have boobs. you see more sex and nudity on tv shows now like Gossip Girl, and Desperate HouseWives those shows are on during the hours kids are still up. Also Jerry Springer is on here at 11am! you cant tell me that kids arent seeing that trash on tv at that hour! Theres not going to be much of a case here if you ask me. after its reviewed its going to be thrown out. Honestly i think people have moved on from this.
 
^^^^I don't know why people make a big deal about the "wardrobe malfunction" but say nothing about Janet's videos like "If" or fondling guys during her concert performances of "Would You Mind" which were shown on television. :p
