State Bar of California recommends lawyer's disbarment

The State Bar of California has recommended that attorney Brian Oxman, whose high-profile client list has included pop star Michael Jackson and the 1-800-GET-THIN surgery marketing company, be disbarred for several violations of bar rules.

In a Jan. 13 order, the State Bar Court said Oxman should lose the ability to practice law because of dishonest and unethical conduct, including failing to advise the bar after he had been fined by a judge and commingling personal funds in a client trust account.

Under the order, Oxman will become inactive Feb. 2, pending a final ruling by the state Supreme Court. It typically takes several months for the Supreme Court to issue a final ruling.

Oxman did not respond to a request for comment.

In its order, the bar cited Oxman's two past disciplinary cases as evidence that he should face the maximum penalty.

"Oxman's three disciplinary proceedings show a disturbing disregard for the administration of justice, including misrepresentations to courts and a failure to cooperate in disciplinary proceedings," the order said.

As a result, the bar said, "We recommend that Oxman be disbarred to protect the public, the courts and the legal profession."

Oxman has made numerous appearances on television as a legal expert. He was part of the defense team during Jackson's 2005 sexual molestation trial. Most recently, he has represented the 1-800-GET-THIN marketing company and its affiliated Lap-Band surgery centers. Last month, he represented the companies during a hearing before the Los Angeles County Board of Supervisors.

On Tuesday, Oxman was named as a defendant in a whistle-blower lawsuit filed against 1-800-GET-THIN by former workers at the surgery centers. Among other things, the lawsuit accused Oxman of attempting to bribe a surgeon to sign a statement that would falsely accuse an opposing lawyer in a wrongful-death lawsuit of ethical violations. The wrongful-death lawsuit had been filed by relatives of a woman who died following Lap-Band surgery at a clinic in West Hills.

I wish they wouldnt have stated he represented Michael in 2005. Its such an embarrasment. He was kicked off the case. THANK GOD .. I kind of wish he would be allowed to represent Joe's case though. Brian is such a crap Lawyer he is bound to loose it.

that's karma for Oxman.. all that crap he talked for years. I still can't believe that @ss got on national television right after MJ died and called MJ an addict and blamed his death on drugs before he even knew the entire story.. I will never forget or forgive for that mess. And even after that the family still allowed that troll to hang around and 'speak' for them. He deserves whatever bad things come his way.

They took long to attempt this. What was the hold up, and notice how they put Michael Jackson into that. Thank God TMez made Oxman disappear. Boo Hoo who will defend papa Joe now?

If I recall correctly, not only was Oxman removed from MJ's defense team but also removed from the courtroom by the judge in 2005.

HAAAAAAAAAAAAA at first I was thinking that there was no one worse than Oxman, but then after thinking it over I decided we can trust papa Joe to find another sleezy incompetent person.

Yes it is, esp as on 25 june and the days following he seemed to be acting as mj's spokesman as he could accurately say he had been mj's lawyer. Clearly the price mj had to pay to get family support during the trial, along with having randy installed as his business manager. Both choices not exactly characterised as spectacular successes.

It seems after the trial judge came with their 2-3 year suspension decision both Oxman and State Bar asked for review of the decision (it's like an appeal). Oxman claimed his punishment should be lower - only 60 day suspension- and State Bar argued that he must be disbarred.

His wife also asked for a review.

Overall during the review , review board agreed with the trial judge's decision , that both Oxman and his wife lacked candor and credibility and were guilty in all accounts.

In Oxman's case they agreed with State Bar and say that as Oxman has 3 prior disciplinary investigations and actions he must be disbarred.

In Oxman's wife case as she has no prior disciplinary actions in her 17 year career, they are recommending her to be suspended with execution stayed - basically putting her on probation. She would be able to work as a lawyer but will need to complete several programs and of course show no wrongdoing.


Well also let me add that the latest file in the Joe Jackson case has been filed by Oxman's wife. It seems like as she's only recommended for stayed suspension / probation, she might take over Oxman's cases.

Good! that's payback for what he did to Mike in 2009 after MJ passed.. Going around on every show that he could calling MJ an addict before he even knew the cause of death. That ticked me off greatly. I am glad his status is inactive. He needs to be disbarred.
